Orleans Parish (New Orleans): The Civil District Court for the Parish of
Orleans has its own clerk's office and may use a specific e-filing platform.
Confirm current system and procedures with the Orleans Civil District Court
clerk's office. The Orleans Parish Clerk's office maintains its own eFiling
portal requirements.

East Baton Rouge Parish: The 19th Judicial District Court in East Baton
Rouge uses electronic filing. Confirm current platform and mandatory e-filing
requirements for civil matters.

Jefferson Parish: 24th Judicial District Court. Confirm current e-filing
requirements and any standing orders from the Clerk of Court.

Required Email in Pleadings: Effective January 1, 2022 (Act No. 68),
attorneys are required to include an email address on every pleading filed.
Verify that opposing counsel has complied with this requirement to ensure valid
email service.

Consent Requirement for Electronic Service. Under Art. 1313(A)(4), consent
must be expressly given. Confirm consent has been obtained and is documented.
Note: For court hearing date notifications under Art. 1313(C), consent of the
receiving party is also required.

PRACTITIONER NOTES

1. Civil Law Terminology. Louisiana is the only U.S. civil law jurisdiction.
Use "petition" (not "complaint"), "petitioner/respondent" where applicable, and
"parish" (not "county"). Some family law and probate proceedings use different
party designations.

2. Act No. 68 (2022). This Act modernized electronic service under Art. 1313.
Key requirements: (a) attorneys must include email addresses on all pleadings;
(b) email service of court hearing dates is now permitted under Art. 1313(C);
(c) electronic confirmation of delivery is required for service to be complete.

3. Email Designation Requirement. For electronic service under Art. 1313(A)(4),
the email address must be expressly designated in a pleading or other writing.
A general business card email or bar directory email may not suffice. Verify the
designated address from the most recent pleading filed by the receiving party.

4. Parish-Specific E-Filing. Louisiana does not use a single statewide
e-filing portal for all courts. Different parishes and judicial districts may use
different systems. Always confirm the current e-filing platform and any standing
orders for the specific court where the case is pending.

5. Sheriff Service — Art. 1314. Certain documents (e.g., pleadings on parties
not represented by counsel) may require personal service by the sheriff. When
Art. 1314 applies, confirm the parish sheriff's procedures and fees, and attach
or reference the sheriff's return of service.

6. Consent for Electronic Service. Retain written evidence of consent for
electronic service under Art. 1313(A)(4). This may be reflected in a filed
stipulation, a pleading containing an email designation, or a separate written
agreement.

7. Some Parishes Require Specific Forms. Certain parish clerks of court
require use of specific proof of service forms. Confirm requirements with the
clerk's office before filing this certificate.
