XVII. PRACTICE TIPS FOR LOUISIANA CIVIL FILINGS

  1. Venue: Verify venue requirements under La. Code Civ. Proc. art. 41 et seq. before selecting the parish and district court for filing.

  2. Prescriptive Periods: Louisiana uses "prescription" rather than "statutes of limitation." For delictual (tort) causes of action accruing on or after July 1, 2024, the prescriptive period is two years under La. Civ. Code art. 3493.1 (enacted by Acts 2024, No. 423; former art. 3492's 1-year period was repealed). For causes accruing before July 1, 2024, the former 1-year period under repealed art. 3492 still applies. Contractual prescription is generally ten years (La. Civ. Code art. 3499).

  3. Medical Malpractice: Claims against qualified healthcare providers must first be submitted to a medical review panel under the Louisiana Medical Malpractice Act (La. R.S. 40:1231.1 et seq.) before filing suit in district court.

  4. Personal Injury Pleading: Under La. Code Civ. Proc. art. 893, petitions for personal injury damages shall not allege a specific monetary amount. Use the range categories in Section VII above.

  5. Service Deadlines: Under La. R.S. 13:5107(D), service must be requested within 90 days after commencement of the action, or the action may be dismissed without prejudice.
