SECTION IV — KYeCOURT / KCOJ eFILING NOTES
Auto-Service via NEF: When a document is filed and accepted through the
KCOJ eFiling system, the system automatically generates and transmits a Notice
of Electronic Filing (NEF) to all registered eFiling participants in the case.
The NEF constitutes service for all registered participants, eliminating the
need for separate service on those parties.2025 Amended Order. Kentucky Supreme Court Order 2025-02 contains amended
rules for eFiling procedures. Attorneys should confirm compliance with the most
current eFiling administrative rules available at kycourts.gov.Jefferson County (Louisville). For Jefferson Circuit Court civil cases,
confirm any local standing orders from the Jefferson Circuit Court Clerk's
office regarding eFiling, service, and certificate requirements, as Jefferson
County has historically maintained specific eFiling protocols.Exemptions from eFiling. Certain parties may be exempt from mandatory
eFiling (e.g., incarcerated pro se litigants, parties without internet access).
If a party is exempt, confirm the authorized alternative service method and
document it carefully.
SECTION V — TIME COMPUTATION / MAIL RULE
Under CR 6.05, when a party must act within a prescribed period after service
and service is made by U.S. Mail, three (3) additional calendar days are
added to the prescribed response period. This addition does not apply to
KYeCourt electronic service (NEF).
Example: A 20-day response period triggered by mail service becomes
23 days from the date of mailing.
If the final day falls on a Saturday, Sunday, or court holiday, the deadline
extends to the next court day under CR 6.01.

PRACTITIONER NOTES
1. "Commonwealth of Kentucky" Heading. Kentucky courts are captioned under
"Commonwealth of Kentucky" rather than "State of Kentucky." Use correct
terminology in all captions and certificates.
2. KYeCourt NEF as Service. Upon filing through KYeCourt, the NEF serves all
registered participants automatically. This eliminates the need to separately
certify service on registered counsel for eFiled documents. However, document
service on any non-registered parties.
3. 2025 Amended Order. Kentucky Supreme Court Order 2025-02 (Amended Order in
Re: Administrative Rules for eFiling) contains updated eFiling requirements.
Review the current version at kycourts.gov before filing.
4. Email Consent. Email service outside the KYeCourt system requires written
consent. Obtain and retain written consent documentation.
5. Three-Day Mail Rule. CR 6.05 adds 3 days for mail service. Calendar all
deadlines accordingly. Adjust for weekends and holidays under CR 6.01.
6. Local Administrative Orders. Jefferson Circuit (Louisville), Fayette
Circuit (Lexington), and other high-volume circuits may have standing orders
addressing service and filing requirements. Check the clerk's office or the
circuit's website for current orders.
7. Appellate Service. For matters in the Court of Appeals or Kentucky Supreme
Court, service requirements under CR 76.12 apply. Include this certificate with
any appellate filings and retain copies for the record.
8. District Court Matters. Kentucky District Courts handle civil cases under
the jurisdictional limit. Confirm that eFiling is available and mandatory for
your specific District Court matter, as availability may vary by county.
