XVII. PRACTICE TIPS FOR KENTUCKY CIVIL FILINGS

  1. Venue: Venue for transitory actions is proper in the county where the defendant resides or where the cause of action arose (KRS 452.010 et seq.). Venue for real property actions is in the county where the property is located (KRS 452.010).

  2. Statutes of Limitation: The general statute of limitations for personal injury in Kentucky is one year from the date of injury (KRS 413.140(1)(a)). For breach of written contract, 15 years (KRS 413.090(2)). For breach of oral contract, 5 years (KRS 413.120(1)). Medical malpractice must be brought within one year from the date of discovery (KRS 413.140(1)(e)).

  3. Medical Malpractice Certificate of Merit: Under KRS 411.167, a medical malpractice complaint must be accompanied by a certificate of merit from a qualified expert.

  4. Certified Mail Service: Kentucky's primary method of service is certified mail, return receipt requested, under CR 4.01. This is a distinctive feature of Kentucky practice.
