Filing

File authorized highly sensitive documents outside CM/ECF by delivering two paper copies or a secure electronic copy to the clerk.

“A party filing an HSD pursuant to a court order or applicable law shall submit to the clerk’s office the HSD, the certificate of service, and, if applicable, a copy of the court order authorizing the treatment of that document as highly sensitive in the form of either two paper copies or an electronic copy on a secure electronic device”

Motions

A represented party seeking highly sensitive treatment must use the ECF Motion to Seal event and omit the proposed sensitive document from the motion.

“A represented party shall file a motion to treat a document as an HSD using the Motion to Seal event in the ECF system. Do not attach a copy of the proposed HSD to the motion.”

Sealing

Parties may resume filing sealed documents in CM/ECF, but electronic notices provide only a placeholder and the documents cannot be viewed electronically.

“Parties may resume filing sealed documents in the CM/ECF system, but the documents will no longer be accessible or viewable to the parties by electronic means.”

Sealing

Serve sealed documents by an appropriate means outside CM/ECF when service is required.

“service of those documents cannot be accomplished through CM/ECF. Parties will need to serve sealed documents by other appropriate means”
