PART X: ALASKA-SPECIFIC PRACTICE NOTES

Court Structure and Judicial Districts

  1. Superior Court. Alaska Superior Court is the state's general jurisdiction trial court. It has four judicial districts:
    - First Judicial District: Southeast Alaska (Juneau, Ketchikan, Sitka)
    - Second Judicial District: Northwest Alaska (Barrow, Kotzebue, Nome)
    - Third Judicial District: Southcentral Alaska (Anchorage, Kenai, Kodiak, Palmer, Valdez)
    - Fourth Judicial District: Interior and Northern Alaska (Fairbanks, Bethel)

  2. District Court. Alaska District Court handles smaller civil matters (generally up to $100,000). For District Court matters, modify the caption by replacing "Superior Court" with "District Court" and using the appropriate case number format (e.g., 3AN-XX-XXXXXCI).

  3. Case Number Format. Alaska case numbers follow the format: [Judicial District Number][Location Code]-[Year]-[Sequential Number][Case Type]. Example: 3AN-25-12345CI (Third Judicial District, Anchorage, 2025, case 12345, Civil).

Filing and TrueFiling

  1. TrueFiling. Alaska courts use the TrueFiling electronic filing system. All documents must be filed electronically through TrueFiling unless an exemption applies. See Alaska Administrative Rule 43.5.

  2. Proposed Order Filing. Proposed orders must be uploaded separately from the stipulation through TrueFiling. When required by the assigned judge, submit an editable Word version of the proposed order to the Order Upload queue. The stipulation and proposed order should be filed as separate PDF documents.

  3. Formatting Requirements. Documents filed in Alaska courts should comply with Alaska R. Civ. P. 77 and applicable administrative orders. Include the case number, court location, and judicial district on all filings.

Pretrial Order Modifications

  1. Initial Pretrial Order. Within 30 days after the appearance of all defendants, the court issues an Initial Pretrial Order. Cases are classified as either "Routine" (standard deadlines apply) or "Non-Routine" (modified deadlines).

  2. Good Cause Standard. Modifications to the Pretrial Order require good cause. Parties may request modifications by motion or stipulation, but "should not presume that changes will be granted, particularly when the change requested affects the ability of the court to timely resolve the case."

  3. Non-Routine Pretrial Orders. For complex cases classified as Non-Routine, a Non-Routine Pretrial Order is issued specifying particular variations from the Routine Pretrial Order. Modifications to Non-Routine orders may require additional justification.

  4. Anchorage Rule 11 Agreements. In the Third Judicial District (Anchorage), certain stipulations may use the CR-470 or CR-475 forms (Rule 11 Agreement and Proposed Judgment). These forms are available on the Alaska Court System website for specific types of stipulated agreements.

Discovery Rules

  1. Initial Disclosures. Alaska R. Civ. P. 26(a)(1) requires initial disclosures without awaiting a discovery request. The timing of initial disclosures is set by the Pretrial Order. Extensions require court approval.

  2. Discovery Modifications. Under Alaska R. Civ. P. 29, parties may stipulate to modify discovery procedures. However, extensions of court-imposed deadlines in the Pretrial Order require court approval.

Service Requirements

  1. TrueFiling Service. Filing through TrueFiling constitutes service on all registered users pursuant to Alaska Administrative Rule 43.5.

  2. Non-TrueFiling Participants. Service on self-represented parties and others not registered in TrueFiling must be accomplished pursuant to Alaska R. Civ. P. 5(b) and Administrative Rule 9 — by mail, hand delivery, or electronic means with consent.

Signatures and Order Requirements

  1. Electronic Signatures. Electronic signatures complying with Alaska Administrative Rule 43.5 are treated as originals.

  2. Judge's Printed Name. Alaska Administrative Rule 4 requires the judge's printed name beneath the signature line on all orders. Include the judge's name in the proposed order if known.

  3. Counterpart Signatures. Stipulations may be executed in counterparts, with each counterpart treated as an original.

About This Template

These are the filings that drive a lawsuit through the system: complaints, answers, motions, briefs, discovery requests and responses, and post-judgment papers. Each has its own format requirements under federal and state procedural rules, and each has a deadline that cannot be missed without consequences. Clean, procedurally correct filings move a case forward; sloppy ones invite motions to strike, amended responses, and avoidable delays.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
