XIV. ALASKA-SPECIFIC RULES AND PRACTICE NOTES

Who May Serve: Under Alaska R. Civ. P. 4, service may be made by a peace officer, a licensed civilian process server (AS 22.20.040), or any competent adult 18 years or older who is not a party. Licensed process servers must pass a written examination and maintain a $15,000 surety bond (13 AAC 67).

Personal Service: Delivering a copy of the summons and complaint to the individual personally, or to an authorized agent by appointment or by law (Rule 4(d)(1)).

Substitute / Abode Service: Leaving copies at the individual's dwelling house or usual place of abode with a person of suitable age and discretion then residing therein (Rule 4(d)(1)).

Service on Corporations: Delivering to an officer, a managing or general agent, or to any other agent authorized by appointment or by law to receive service of process (Rule 4(d)(3)-(4)).

Certified Mail: Alaska R. Civ. P. 4(d)(7)-(8) permits service by certified mail, return receipt requested, restricted delivery.

Service by Publication: Requires prior court order under Rule 4(e). Publication must be once a week for four consecutive weeks. The defendant must be given at least 30 days after the last publication date to appear.

Posting and Mailing (Landlord-Tenant): AS 34.03.260 permits service in landlord-tenant actions by posting on the premises and mailing by first-class mail on the same day.

Proof of Service: Rule 4(f) requires the person serving process to make proof of service, stating the time, place, and manner of service. If service is by a person other than a peace officer, proof shall be by affidavit.

Unsworn Declarations: AS 09.63.020 allows unsworn declarations under penalty of perjury in lieu of notarized affidavits for many civil filings, subject to court approval.

Filing Deadline: The completed Affidavit of Service should be filed promptly with the Clerk of Court to start the defendant's response clock. In Superior Court, the defendant generally has 20 days to answer after personal service.

Out-of-State Service: For service upon a party outside Alaska, service shall be made by a sheriff, constable, bailiff, peace officer, or other officer having like authority in the jurisdiction where service is made, or by a person specifically appointed by the court.
