Arizona Roommate Agreement

Before you use this: Select each person's lease status. A co-tenant signs the property owner's lease; a subtenant rents from a tenant. Obtain any approval required by the master lease or housing program. This agreement allocates household costs and duties, but it cannot release a co-tenant from the property owner's lease.

1. Lease rights and permission

If all are co-tenants: The owner's deposit under the master lease is separate from a roommate's internal contribution. An early departure alone does not end the master tenancy or require the owner to refund one co-tenant's portion. The roommates will record any buyout or replacement contribution in a signed departure statement. When the owner returns the master deposit, the roommates will allocate the balance using documented contributions, individual deductions, and shared deductions, then pay each share within [____] days after receipt.

If a subtenant pays Sublessor a separate deposit: Security, including prepaid rent, that Sublessor demands or receives will not exceed one and one-half months' sublease rent. Any nonrefundable fee or deposit must have its purpose stated here in writing: [PURPOSE AND AMOUNT / NONE]; an amount not designated nonrefundable is refundable. On move-in Sublessor will deliver a signed copy of the sublease terms, a move-in damage form, and written notice that Subtenant may be present at the move-out inspection. Sublessor will give the inspection time on request, subject to the statutory exception in A.R.S. § 33-1321(C). The roommates may use this signed Agreement as their sublease terms if its subtenant fields are complete.

After the subtenancy ends, Subtenant delivers possession, and Subtenant demands a return, Sublessor will provide an itemized list of deductions and any amount due within 14 days excluding Saturdays, Sundays, and legal holidays. Deductions are limited to amounts permitted by the signed agreement and Arizona law, subject to mitigation. Unless Subtenant makes other written arrangements, Sublessor will mail the list and any amount due by first-class mail to Subtenant's last known residence. Subtenant's forwarding address and demand may be given here or separately: [ADDRESS / TO BE PROVIDED]. A Subtenant who does not dispute the mailed list or amount due within 60 days after mailing may waive further claims to that amount under § 33-1321(D).

4. Rooms, guests, and household duties

Each roommate will keep shared areas reasonably clean, promptly report needed repairs to [OWNER/MANAGER AND CONTACT], and respect others' private rooms and property. No roommate may enter another's private room without permission except as the lease or law permits. A roommate responsible for documented damage will pay that roommate's lawful share after owner accounting or insurance payment is considered.

5. Departure, replacement, and disputes

A roommate planning to leave will give written notice to the others and, where required, the property owner. For a separate month-to-month subtenancy, either Sublessor or Subtenant may end it by written notice to the other at least 30 days before the periodic rental date stated in the notice, under A.R.S. § 33-1375(B). Sublease rent due date: [DAY]. A co-tenant's notice or move-out does not itself release that person from the owner's lease; obtain a signed owner release or amendment if needed. A fixed term follows its term and applicable law.

A replacement must obtain any required owner or program approval and sign a new or amended roommate agreement before moving in. No roommate may remove another solely by a vote, changing locks, or taking property. The roommates will first discuss a dispute using the relevant bill, condition record, or house rule, and may choose voluntary mediation through [SERVICE / NONE].

Arizona law governs. No term waives a nonwaivable right or changes the owner's lease without the owner's agreement. An unenforceable term does not cancel the remaining lawful terms.
