ROOMMATE AGREEMENT

Before you use this: Check the lease, landlord consent, and law for the property before assigning rooms, collecting payments, adding an occupant, or ending anyone's occupancy. This agreement governs the roommates' arrangements with each other; it does not change the landlord's rights or a person's rights under the lease.

1. Term and rooms

This Agreement begins [__/__/____] and continues until [__/__/____ / MONTH TO MONTH], subject to the lease and applicable law. It ends for a roommate only as provided in a written departure agreement or a lawful termination process; moving out alone does not release a duty owed to the landlord or another roommate.

Kitchen, bathroom, living areas, and other common space will be shared as follows: [DETAILS]. Room assignments change only by a written agreement of the affected roommates and any landlord approval required by the lease or law.

2. Rent and payments

Total rent due under the lease or occupancy agreement: $[AMOUNT] per [MONTH / OTHER PERIOD], due to [LANDLORD OR PAYEE] on [DAY].

3. Deposit and shared property

When the deposit holder returns funds, the roommates will account for each person's contribution, any documented deduction attributable to that person, and any documented shared deduction. They will distribute the remaining funds by [AGREED METHOD] within [NUMBER] days after the holder's refund, subject to applicable law. A roommate does not automatically forfeit a deposit share by moving out early. If someone leaves before the lease ends, the parties will record any settlement of that share in writing.

4. Utilities and household expenses

Each roommate will keep shared areas reasonably clean, promptly tell the others and the landlord or manager about a condition needing repair, and respect the others' private rooms and property. No roommate may enter another's private room without permission except as the lease or applicable law permits. A roommate responsible for damage will reimburse a documented and lawful cost attributable to that roommate, after any insurance or landlord accounting is considered.

6. Changes, departures, and disputes

A roommate who plans to leave will give written notice to [OTHER ROOMMATES AND, IF REQUIRED, LANDLORD] by the period required by the lease or applicable law; any additional agreed notice period is [NUMBER] days, if lawful. A replacement must have any consent required by the lease or law and must sign a new or amended agreement before moving in. No roommate may remove another person from the Home solely by a vote or by changing locks.

The roommates will first try to resolve a dispute by discussing the relevant bill, damage record, or house rule. They may agree to use mediation through [SERVICE OR "NONE"]. A roommate may seek a remedy available under the lease, this Agreement, and applicable law. This Agreement does not require arbitration or waive a jury trial.
