ROOMMATE AGREEMENT (ARKANSAS)

Before you use this: This agreement is for people named as tenants under the same residential Lease. Attach the Lease and its amendments. If one person will rent space from another instead of being a co-tenant, use a sublease that addresses the master landlord's consent.

This Roommate Agreement is made on [__/__/____] among the following named tenants of [STREET ADDRESS, UNIT, CITY, AR ZIP] (the "Home"):

Roommate Notice address or email Monthly rent share Share of landlord-held deposit
[FULL LEGAL NAME] [ADDRESS / EMAIL] $[AMOUNT] $[AMOUNT]
[FULL LEGAL NAME] [ADDRESS / EMAIL] $[AMOUNT] $[AMOUNT]
[FULL LEGAL NAME, IF ANY] [ADDRESS / EMAIL] $[AMOUNT] $[AMOUNT]

The parties are tenants under the residential lease dated [__/__/____] with [LANDLORD NAME] (the "Lease"), attached as Exhibit A. The Lease is ☐ month-to-month ☐ for a fixed term ending [__/__/____]. This Agreement divides duties among roommates; it does not amend the Lease or bind the landlord.

1. Rooms and shared space

This Agreement begins [__/__/____] and continues while the signers share the Home, subject to Section 8. Private rooms or exclusive areas: [ASSIGNMENTS]. Shared areas: [KITCHEN / BATH / LIVING ROOM / OTHER]. Each roommate may use shared areas reasonably without excluding the others.

2. Rent and payment

Total monthly Lease rent is $[TOTAL]. Each roommate's share appears above. Rent is due to the landlord on the [__] day of each month. The roommates choose this payment arrangement:

☐ Each roommate pays the landlord directly, if the landlord accepts separate payments.

☐ Each roommate pays [RENT COORDINATOR] by day [1-28] of each month. The coordinator will send the full rent to the landlord by the Lease deadline and give the others proof of payment.

Record each roommate's first full share, if any, and any earlier partial share. The first full share is the monthly amount listed above; a partial share replaces that amount for its covered dates and is not an extra charge. Write "none" for a first full period that never occurs, including when the agreed stay fits within a partial month. Payments to the landlord remain subject to the Lease and the landlord's acceptance of separate payments.

Roommate First full share period and due date Initial partial period Partial share, payee, and due date
[NAME] [START THROUGH END; DUE DATE / NONE] [START THROUGH END / NONE] $[AMOUNT / ZERO] to [PAYEE / NONE] due [__/__/____ / NONE]
[NAME] [START THROUGH END; DUE DATE / NONE] [START THROUGH END / NONE] $[AMOUNT / ZERO] to [PAYEE / NONE] due [__/__/____ / NONE]
[NAME] [START THROUGH END; DUE DATE / NONE] [START THROUGH END / NONE] $[AMOUNT / ZERO] to [PAYEE / NONE] due [__/__/____ / NONE]

For the initial partial-share dates, any difference between total rent owed under the Lease and these internal shares is paid by [ROOMMATE(S), AMOUNTS, PAYEE, AND DUE DATES / NONE]. This allocation does not reduce rent owed to the landlord.

If the fixed-term Lease ends during a monthly share period, record each roommate's final partial share below; otherwise write "none." For the listed dates, a completed final partial share replaces that roommate's ordinary share. If initial and final partial dates are the same, use the initial row only and mark the final row "none." Credit any share already paid for covered dates: $[AMOUNT / ZERO] paid by [ROOMMATE / NONE] for [DATES / NONE]. Payments use the selected landlord or coordinator route above. Any difference between total rent owed under the Lease and these internal shares is paid by [ROOMMATE(S), AMOUNTS, AND DUE DATES / NONE]; this allocation does not reduce rent owed to the landlord.

Roommate Final partial dates Partial share, payee, and due date
[NAME] [START]–[END / NONE] $[AMOUNT / ZERO] to [PAYEE] due [__/__/____ / NONE]
[NAME] [START]–[END / NONE] $[AMOUNT / ZERO] to [PAYEE] due [__/__/____ / NONE]
[NAME] [START]–[END / NONE] $[AMOUNT / ZERO] to [PAYEE] due [__/__/____ / NONE]

A roommate who pays more than that roommate's share to prevent a default may demand reimbursement of the excess from the roommate who owed it within [__] days after showing the receipt. This internal allocation does not change the landlord's rights under the Lease. No roommate late fee is agreed.

3. Utilities and shared expenses

Expense Account holder Allocation Payment date
Electricity/gas [NAME] [EQUAL / FORMULA] [DAY]
Water/sewer [NAME] [EQUAL / FORMULA] [DAY]
Internet [NAME] [EQUAL / FORMULA] [DAY]
Household supplies [NAME] [EQUAL / FORMULA] [DAY]
Other: [DESCRIBE] [NAME] [FORMULA] [DAY]

An account holder will share each bill before requesting reimbursement. An unlisted shared purchase requires written approval from the roommates who will pay for it.

4. Deposit and damage allocation

The landlord holds or will receive a total security deposit of $[TOTAL]. Each roommate's contribution is listed above. No roommate receives a separate security deposit from another under this Agreement.

When the landlord returns a jointly payable deposit, the roommates will distribute it according to their contributions and the landlord's itemization, adjusting among themselves for damage proved to have been caused by a particular roommate or guest. A roommate who receives the landlord's refund or itemization will share a copy with the others within [__] days and pay each other's undisputed allocated share within [__] days after receiving the funds. A roommate who leaves early may arrange a written internal buyout with a replacement or the continuing roommates; the landlord's deposit duties and the Lease remain as they are unless the landlord agrees to a change.

5. Use, guests, care, and repairs

Each roommate will comply with the Lease, keep a private area reasonably clean, and follow this shared-area cleaning plan: [SCHEDULE]. Quiet hours: [HOURS]. Overnight guests: [RULES CONSISTENT WITH LEASE]. Keys and new occupants require any approval stated in the Lease and the written agreement of all affected roommates.

A roommate who learns of a needed repair will notify the landlord as the Lease directs and tell the others. A roommate will reimburse the others for damage that roommate or that roommate's guests cause beyond ordinary wear, to the extent shown by a condition record, receipt, or written agreement.

6. Shared decisions and changes

The roommates will decide shared purchases, new occupants, and changes to private-space assignments by written agreement of everyone affected. An amendment to this Agreement must be signed by all roommates. A roommate decision cannot change a Lease term or substitute for required landlord consent.

7. Disputes

A roommate will describe a shared-expense or use dispute in writing to the others. The roommates will meet within [__] days and record any resolution in writing. This process does not postpone a rent or notice deadline owed to the landlord.

8. Departure and the underlying Lease

A roommate planning to leave will give the others at least [30] days' written notice and cooperate in any notice, consent, or replacement process under the Lease. Moving out or giving notice only to the roommates does not itself amend the Lease or release a signer from obligations to the landlord. The roommates may agree in writing on an internal buyout or replacement allocation, subject to any landlord approval needed to change the Lease.

If the underlying Lease is month-to-month, Ark. Code Ann. § 18-17-704(b) permits the landlord or tenant to end that tenancy by written notice to the other at least 30 days before the termination date stated in the notice. The roommates will coordinate before sending a notice intended to end that tenancy. This Roommate Agreement is not that landlord-tenant notice. Any issue about continued possession or removal will follow controlling law; no roommate may rely on this Agreement as permission to lock out another.

9. General terms

Arkansas law governs this Agreement. Controlling law prevails over a conflicting term. This Agreement and Exhibit A are the full agreement among the roommates about shared expenses and use until they sign a later writing.

Legal authority

  • Ark. Code Ann. § 18-17-704(b) (underlying month-to-month tenancy notice)

Real estate documents transfer ownership, define who can use a property, and record agreements between buyers, sellers, landlords, and tenants. Deeds, purchase agreements, leases, and easements have to be drafted to meet state recording requirements, and mistakes show up at closing or years later in title disputes. Good real estate paperwork moves transactions forward quickly and avoids the kind of problems that only surface when it is time to sell or refinance.
