Alabama Roommate Agreement

Before you use this: Choose each person's status below. A co-tenant signs the landlord's lease; a subtenant rents from a tenant. Obtain any landlord approval the master lease or housing program requires. This Agreement divides household costs and duties but does not release anyone from the landlord's lease.

1. Lease rights and permission

If all are co-tenants: The landlord holds the master-lease deposit. An early move-out does not require the landlord to return one co-tenant's portion while the master tenancy continues. The roommates will record any buyout or replacement contribution in a signed departure statement. When the landlord eventually refunds the deposit, they will allocate the balance by contributions, documented individual deductions, and documented shared deductions, then pay each share within [____] days after receipt.

If a subtenant pays Sublessor a separate deposit: It is refundable, no greater than one month's sublease rent, with no added pet or special-risk deposit under this Agreement. Sublessor may deduct accrued rent and documented damage caused by Subtenant's noncompliance with this Agreement, excluding ordinary wear, as Alabama law allows. Within 60 days after the subtenancy terminates and Subtenant delivers possession, Sublessor will mail any refund and a written itemization of deductions. Subtenant will give Sublessor a valid forwarding address in writing on leaving: [ADDRESS / TO BE PROVIDED]. If none is provided, Sublessor will mail by first-class mail to Subtenant's last known address or, if none, to the property address as Ala. Code § 35-9A-201(d) directs.

4. Rooms, guests, and household duties

Each roommate will keep shared areas reasonably clean, promptly report needed repairs to [LANDLORD/MANAGER AND CONTACT], and respect the other roommates' private rooms and property. No roommate may enter another's private room without permission except as the lease or law permits. A roommate responsible for documented damage will pay that roommate's lawful share after landlord accounting or insurance payment is considered.

5. Departure, replacement, and disputes

A roommate planning to leave will give written notice to the others and, where required, the landlord. For a separate month-to-month subtenancy, either Sublessor or Subtenant may end it by written notice to the other at least 30 days before the periodic rental date stated in the notice, under Ala. Code § 35-9A-441(b). Sublease rent due date: [DAY]. A co-tenant's notice or move-out does not by itself release that person from the landlord's lease; obtain a signed landlord release or amendment if needed. A fixed-term tenancy follows its term and applicable law.

A replacement must obtain any required landlord or program approval and sign a new or amended roommate agreement before moving in. No roommate may remove another solely by a vote, changing locks, or taking property. The roommates will first discuss a dispute using the relevant bill, condition record, or house rule, and may choose voluntary mediation through [SERVICE / NONE].

Alabama law governs. No term waives a nonwaivable right or changes the landlord's lease without the landlord's agreement. An unenforceable term does not cancel the remaining lawful terms.
