CONSEQUENCES OF NON-COMPLIANCE

- Filing a Forcible Entry and Detainer (FED) action in the appropriate Alaska District Court pursuant to AS 09.45.060 et seq.;
- Seeking a judgment for possession of the premises;
- Seeking a money judgment for all unpaid rent, late fees, court costs, and reasonable attorney's fees as permitted by the lease agreement and Alaska law;
- Any other remedies available at law or in equity.

Right to Cure: Under AS 34.03.220(b), if you pay the full amount of rent due within the seven (7) day notice period, this notice shall be void and your tenancy shall continue according to its terms.

Limitation on Cure Right: If rent is unpaid when due and the tenant fails to pay rent within seven days after written notice by the landlord of nonpayment and the landlord's intention to terminate the rental agreement if the rent is not paid within that period, the landlord may terminate the rental agreement. However, if substantially the same act or omission that constituted a prior noncompliance recurs within six months, the landlord may terminate the rental agreement upon at least five days' written notice specifying the breach and the date of termination of the rental agreement.
