CONSEQUENCES OF NON-COMPLIANCE

If you fail to pay the full amount owed or vacate the premises within the seven (7) day period, the Landlord will pursue legal remedies available under Alaska law, including but not limited to:

  • Filing a Forcible Entry and Detainer (FED) action in the appropriate Alaska District Court pursuant to AS 09.45.060 et seq.;
  • Seeking a judgment for possession of the premises;
  • Seeking a money judgment for all unpaid rent, late fees, court costs, and reasonable attorney's fees as permitted by the lease agreement and Alaska law;
  • Any other remedies available at law or in equity.

IMPORTANT LEGAL NOTICES

  1. Right to Cure: Under AS 34.03.220(b), if you pay the full amount of rent due within the seven (7) day notice period, this notice shall be void and your tenancy shall continue according to its terms.

  2. Limitation on Cure Right: If rent is unpaid when due and the tenant fails to pay rent within seven days after written notice by the landlord of nonpayment and the landlord's intention to terminate the rental agreement if the rent is not paid within that period, the landlord may terminate the rental agreement. However, if substantially the same act or omission that constituted a prior noncompliance recurs within six months, the landlord may terminate the rental agreement upon at least five days' written notice specifying the breach and the date of termination of the rental agreement.

  3. Military Personnel: If you are a servicemember on active duty, you may have additional rights under the federal Servicemembers Civil Relief Act (50 U.S.C. § 3901 et seq.). Consult with a legal assistance attorney or JAG officer.

  4. Legal Assistance: If you cannot afford an attorney, you may contact the Alaska Bar Association Lawyer Referral Service at (907) 272-0352 or Alaska Legal Services Corporation for possible assistance.


RESERVATION OF RIGHTS

This notice is made without waiving any rights or remedies of the Landlord, all of which are expressly reserved. Acceptance of partial payment does not waive the Landlord's right to proceed with eviction for the remaining balance unless expressly agreed in writing.
