ALASKA MECHANICS LIEN WAIVER AND RELEASE PACK

Pursuant to Alaska Statutes AS 34.35.050 - 34.35.120

ALASKA-SPECIFIC PRACTICE NOTES

Statutory Framework for Lien Waivers

Alaska mechanics lien law is codified at AS 34.35.050 through AS 34.35.120. Under AS 34.35.117, lien waivers in Alaska operate as follows:

(a) A written waiver of lien or stop-lending notice rights signed by a claimant requires no consideration and is valid and binding. However, a waiver may not relate to labor, materials, services, or equipment furnished after the date the waiver is signed.

(b) An individual described in AS 34.35.120(10) (individual employees performing labor) may not waive their right to claim a lien. Any purported waiver of such rights is void.

Lien Filing Deadlines (AS 34.35.068)

Without Notice of Completion:
☐ 120 days after claimant completes the construction contract; OR
☐ 120 days after claimant ceases to furnish labor, material, services, or equipment

With Notice of Completion (AS 34.35.071):
☐ Record a Claim of Lien or Notice of Right to Lien within 15 days after the Notice of Completion is recorded if the claimant:

  • Received advance notification of the recording date; OR
  • Had not given a Notice of Right to Lien

☐ 120 days preserved if claimant:

  • Recorded a Notice of Right to Lien before or within 15 days after the Notice of Completion; OR
  • Gave a Notice of Right to Lien but did not receive advance notification of the recording date

Notice Requirements

☐ Notice of Right to Lien (AS 34.35.064): A claimant may give this notice before furnishing work; a compliant notice shifts the owner-knowledge burden and can preserve the 120-day claim-recording period after an owner's notice of completion

☐ Notice of Completion (AS 34.35.071): Owner may record after project completion; triggers shortened 15-day deadline for certain claimants

Stop-Lending Notice Rights (AS 34.35.062)

☐ Claimants with past-due payments may serve a stop-lending notice on the construction lender

☐ Stop-lending notice expires on the 91st day after the lender receives it unless the claimant starts an action on the underlying claim before that day and the lender receives written notice of the action

☐ A lender who disburses after receiving a binding stop-lending notice may be liable to the claimant, subject to AS 34.35.062(c)'s limits and proof requirements

☐ Waivers under AS 34.35.117 apply to both lien rights AND stop-lending notice rights

Lien Duration and Enforcement (AS 34.35.080)

☐ A recorded lien binds real property for 6 months after recording

☐ A notice of extension recorded in the same recording office within the original six months can permit an enforcement action within six months after that notice is recorded

☐ If no enforcement action is commenced within the applicable period, the lien expires

Parties with Lien Rights (AS 34.35.050)

  1. Persons performing labor on real property at the owner-or-agent's request
  2. Trustees of employee benefit trusts with direct owner-or-agent contracts for trust payments
  3. Persons furnishing materials under owner-or-agent contracts, delivered to the property and incorporated in the improvement
  4. Persons furnishing equipment delivered to and used on the property under an owner-or-agent contract
  5. Architects, surveyors, engineers, landscape architects, and registered interior designers who meet AS 34.35.050(5)'s owner-or-agent contract condition, as amended by § 35, ch. 23 SLA 2026
  6. General contractors

Key Practice Considerations

☐ Written Waiver Required: All waivers must be in writing and signed by the claimant

☐ No Consideration Necessary: Alaska law explicitly states consideration is not required
