RCW 49.60.222(2)(b) prohibits refusing a reasonable housing accommodation in rules, policies, practices, or services when it may be necessary for equal opportunity to use and enjoy a dwelling. Washington State Human Rights Commission guidance distinguishes the narrow trained-service-animal definition used outside housing from the housing accommodation route, under which an assistance animal may include an untrained emotional-support animal.
The Commission's housing guidance states that no-pets rules and pet fees should not be applied to a qualifying assistance animal. Necessity and disability-related need still require individualized review. HUD's May 2026 federal enforcement policy does not amend Washington law.
