UTAH SERVICE RULES — QUICK REFERENCE

Primary Authority: Utah Rules of Civil Procedure Rules 5 and 6 govern service of papers after the initial summons in Utah civil actions.

Who Must Be Served (Utah R. Civ. P. 5(a)): Every pleading subsequent to the original complaint unless the court orders otherwise; every paper relating to discovery required to be served; every written motion (except one heard ex parte); and every written notice, appearance, demand, offer of judgment, and similar paper must be served on each party. Service on a represented party is made upon their attorney.

Authorized Methods of Service (Utah R. Civ. P. 5(b)):

  1. Electronic filing: A document is served by submitting it for electronic filing through the Utah Courts electronic filing system (MyCase), if the person being served has an electronic filing account. This is the primary method for attorneys.
  2. Email: Serving by transmitting to an email address that the person has designated for service in this case or in another filing in the same court.
  3. Hand delivery: Delivering a copy in person to the attorney or party.
  4. Mail: Mailing a copy to the person's last known address; service is complete upon mailing.
  5. Commercial carrier: Leaving a copy with a commercial carrier for delivery to the person's last known address.
  6. Fax: Faxing a copy to a fax number the person has designated for service.
  7. Posting: At a location the court designates.

No Certificate Required for Electronic Filing Service: Under Utah R. Civ. P. 5(d), no certificate of service is required when a document is served through an electronic filing account (MyCase). However, when a document is served by email, mail, or other non-electronic-filing methods, a certificate of service must be filed with the document or within a reasonable time after service, showing the date and method of service, including the email or mailing address used.

Mail Service — Three-Day Extension (Utah R. Civ. P. 6(d)): When a party may or must act within a specified time after service, and the paper was served by mail, three (3) additional days are added to the period. No extension applies to electronic filing service or other electronic service.

Utah E-Filing System — MyCase: The Utah Courts operate MyCase (utcourts.gov) as the electronic filing and case management system. Attorneys with an electronic filing account are required to file documents electronically. When a document is submitted through MyCase, the system automatically serves all other registered participants. Attorneys must register and maintain an active MyCase account.

Email Service: Email service is permitted when the person being served has designated an email address for service in this case or another filing in the same court. When served by email outside of MyCase, a certificate of service must be filed.

Service on Unrepresented Parties (Utah R. Civ. P. 6 Note): When a party is not represented by an attorney and does not have an electronic filing account, and must act within a specified time after the filing of a paper, the period runs from the service date rather than the filing date. This protects self-represented parties who may not have access to real-time filing notifications.

Safeguarded Information: Address information for safeguarded persons (e.g., domestic violence victims) must not be included in the certificate of service. Follow Utah R. Civ. P. 26(c) and Rule 4-202.02 of the Utah Code of Judicial Administration.
