PART VII: MICHIGAN-SPECIFIC PROCEDURAL NOTES

7.1 Scope of Service Obligation — MCR 2.107(A)

Unless an exception applies, every party who has filed a pleading, appearance, or motion must be served with documents later filed in the action. Service is generally made on a represented party's attorney under MCR 2.107(B), subject to the listed exceptions.

7.2 Computing Deadlines

• Do not add two days merely because service was by mail; current MCR 2.108 contains no such extension.
• Use the rule governing the particular response or act. For example, MCR 2.119(C) supplies motion-service and response timing unless another rule or court order changes it.
• Under MCR 1.108, exclude the triggering day. If the last day is a Saturday, Sunday, legal holiday, or court-closure day, the period runs through the next day that is not one of those days.

7.3 Electronic-Filing-System Service

MCR 1.109(G)(6) governs electronic service through the court's approved system. It does not replace the service rules for case-initiating documents, and exempt or unregistered parties require another authorized service method. Retain the system's service-transaction record. If a served transmission is reported undeliverable, immediately use regular mail or authorized delivery and preserve the failure notice as required by MCR 1.109(G)(7)(d).

7.4 Caption and Contact Information

MCR 1.109(D)(1) governs required caption information, including the attorney's name, business address, telephone number, and State Bar number. Confirm the recipient information used for service against the case record and applicable electronic-service agreement or system.

7.5 Proof of Service — MCR 2.107(D)

Proof of service must be a written acknowledgment or a written statement by the individual who served the documents, verified under MCR 1.109(D)(3). It may appear at the end of the filed document and must be filed promptly and no later than the related hearing.

7.6 Service of Original Process

This template is for documents served after case initiation. Original process is governed by MCR 2.103-2.106, and proof of original service is governed by MCR 2.104. Do not use MCR 2.107 alone to serve a summons and complaint.

7.7 Electronic Service Outside the Court System

MCR 2.107(C)(4) allows parties to file a stipulation for alternative electronic service by email, text message, or secure-site alert. MCR 2.107(G) separately directs electronic service, including email or fax where available, to the greatest extent possible.
