PART VII: MAINE PROCEDURAL NOTES AND RULES REFERENCE
7.1 Rule 5 — Scope of Service Requirement
Under M.R. Civ. P. 5(a), every pleading subsequent to the original complaint, every written motion (other than ex parte motions), notices, demands, and similar papers shall be served upon each of the parties. Service upon a party represented by an attorney shall be made upon the attorney unless the court orders direct service upon the party.
7.2 Rule 5(d) — Filing After Service
All papers required to be served shall be filed with the court either before service or within a reasonable time after service. The certificate of service shall accompany or be endorsed upon the filed document. Attorneys using Odyssey EFS satisfy both the filing and service requirement upon successful transmission.
7.3 Rule 6 — Time Computation and Mail Extension
- Day zero rule: The day of the act, event, or default from which the designated period begins to run is not counted (M.R. Civ. P. 6(a)).
- Weekends and holidays: If the last day of a period falls on a Saturday, Sunday, or Maine legal holiday, the period extends to the next business day.
- Short periods (under 11 days): Intermediate Saturdays, Sundays, and legal holidays are excluded (M.R. Civ. P. 6(a)).
- Mail service extension: When a party must act within a period after service by mail, add 3 days to the prescribed period (M.R. Civ. P. 6(e)).
- No mail extension for e-service: The 3-day extension does not apply to electronic service through Odyssey EFS or email.
7.4 Maine Odyssey Electronic Filing System
- Maine courts operate the Odyssey Case Management System as the state e-filing platform.
- Attorneys admitted to the Maine Bar practicing in courts where Odyssey is active are generally required to e-file.
- The Odyssey system generates a Notice of Electronic Filing (NEF) which constitutes service on all co-registered parties.
- Mandatory e-filing requirements vary by court type and case category; check the specific court's administrative orders.
- Non-attorneys (self-represented parties) may register voluntarily; if not registered, conventional service is required.
- Technical failures: If the Odyssey system is unavailable due to a technical failure at the time of a filing deadline, filers should document the failure and file by the earliest opportunity thereafter.
7.5 Facsimile and Email Service — Consent Requirements
Under Maine practice and M.R. Civ. P. 5, fax and email service on non-registered parties requires either:
(1) written consent by the receiving party or attorney, or
(2) a court order specifically authorizing such service.
Consent should be documented in writing and retained in the file.
7.6 Service When Multiple Attorneys Represent a Party
When a party is represented by more than one attorney, service on any one attorney of record is sufficient unless the court orders otherwise.
7.7 Certificate of Service — Form and Placement
Maine practice allows the certificate of service to be:
- Incorporated at the end of the document being filed
- Attached as a separate page following the signature block
- Filed as a standalone document in limited circumstances
The certificate must identify: (1) the name and address of each person served, (2) the method of service used, and (3) the date of service.
