COLORADO PROCEDURAL NOTES
Simplified Procedure — Key Rules Under C.R.C.P. 16.1
- Monetary Cap: In cases subject to Simplified Procedure, a claimant's right to a monetary judgment against any one party is limited to $100,000, including penalties and punitive damages but excluding attorney fees, interest, and costs. C.R.C.P. 16.1(b).
- Discovery Limits: Simplified Procedure cases have streamlined discovery rules, including limits on interrogatories (maximum 25, including subparts) and depositions. C.R.C.P. 16.1(f).
- Case Management: The court will set a case management conference early in the litigation. C.R.C.P. 16.1(e).
- Removal from Simplified Procedure: Any party may remove a case from Simplified Procedure by filing a cover sheet certifying that the party seeks more than $100,000. C.R.C.P. 16.1(b).
Commencement of Action
- A civil action is commenced by filing a complaint and paying the filing fee. C.R.C.P. 3.
Response Deadline
- A defendant must serve an answer within 21 days after service of the summons and complaint. C.R.C.P. 12(a).
Certificate of Review for Professional Negligence
- Any person who files a professional negligence action must file a certificate of review within 60 days of service of the complaint. Colo. Rev. Stat. § 13-20-602.
Construction Defect Cases
- Construction defect cases are subject to the Construction Defect Action Reform Act (CDARA), Colo. Rev. Stat. § 13-20-801 et seq., which requires notice and opportunity to cure before filing suit.
Governmental Immunity
- Claims against governmental entities are subject to the Colorado Governmental Immunity Act, Colo. Rev. Stat. § 24-10-101 et seq., including notice requirements (180 days for filing).
E-Filing
- Colorado courts use ICCES (Integrated Colorado Courts E-Filing System). E-filing is mandatory in most judicial districts. Check local rules for specific requirements.
