ARTÍCULO 1: DEFINICIÓN DE MEDIACIÓN / DEFINITION OF MEDIATION

La mediación es un proceso voluntario en el cual un mediador neutral facilita la comunicación entre las partes para ayudarlas a alcanzar una resolución mutuamente aceptable de su disputa. El mediador no actúa como juez, árbitro, abogado o terapeuta de ninguna de las partes.

Mediation is a voluntary process in which a neutral mediator facilitates communication between the parties to help them reach a mutually acceptable resolution of their dispute. The mediator does not act as a judge, arbitrator, attorney, or therapist for any party.

ARTÍCULO 2: VOLUNTARIEDAD / VOLUNTARINESS

Las partes acuerdan que:

☐ Cualquier parte puede retirarse de la mediación en cualquier momento
☐ Ningún acuerdo será vinculante hasta que sea firmado por todas las partes

ARTÍCULO 3: CONFIDENCIALIDAD / CONFIDENTIALITY

3.1 Todas las comunicaciones, declaraciones, ofertas y documentos realizados o presentados durante la mediación serán confidenciales y no serán divulgados a terceros, excepto según lo acordado por las partes o según lo requiera la ley.

All communications, statements, offers, and documents made or presented during mediation shall be confidential and shall not be disclosed to third parties, except as agreed by the parties or as required by law.

3.2 Las excepciones a la confidencialidad incluyen / Exceptions to confidentiality include:

☐ Amenazas de violencia o daño / Threats of violence or harm
☐ Sospecha de abuso o negligencia infantil / Suspected child abuse or neglect
☐ Sospecha de abuso de ancianos / Suspected elder abuse

3.3 Las partes acuerdan no citar al mediador como testigo ni solicitar la producción de notas o registros del mediador en cualquier procedimiento legal futuro.

The parties agree not to subpoena the mediator as a witness or request production of the mediator's notes or records in any future legal proceeding.

ARTÍCULO 4: ROL DEL MEDIADOR / ROLE OF MEDIATOR

El mediador:

ARTÍCULO 5: BUENA FE / GOOD FAITH

Las partes acuerdan participar en la mediación de buena fe, lo que incluye:

The parties agree to participate in mediation in good faith, which includes:

ARTÍCULO 6: AUTORIDAD PARA RESOLVER / AUTHORITY TO SETTLE

Las partes declaran que tienen plena autoridad para negociar y celebrar un acuerdo vinculante, o que la persona con dicha autoridad estará presente o disponible durante la mediación.

The parties represent that they have full authority to negotiate and enter into a binding agreement, or that the person with such authority will be present or available during mediation.
