17. ALASKA PRACTICE NOTES

  • Process after filing. ASCHR staff conduct an intake interview, draft a formal complaint, and serve it on Respondent. Respondent files an Answer (Position Statement). Staff convene a Resolution Conference under AS 18.80.135 to attempt early resolution. If unresolved, the case proceeds to investigation; ASCHR has subpoena power under AS 18.80.120.
  • Typical timeline. Investigation often takes 12–24 months. Cases may be resolved by negotiated settlement, administrative dismissal (no substantial evidence), or finding of substantial evidence followed by conciliation and, if necessary, public hearing before an administrative law judge.
  • Right to sue (state). Unlike Title VII, Alaska law does not require a Right-to-Sue letter from ASCHR before filing a civil action under AS 22.10.020(i). Complainants may file in Superior Court at any time, subject to the 2-year limitations period in AS 09.10.070.
  • Withdrawal for civil action. Complainants who wish to pursue a civil action may request withdrawal of the ASCHR charge. Withdrawal is generally granted but should be coordinated with the federal EEOC charge to preserve federal claims.
  • Right to sue (federal). EEOC will issue a Notice of Right to Sue on Title VII / ADA / ADEA / GINA claims after 180 days from filing (or earlier on request). Civil action must be filed within 90 days of receipt.
  • Continuing-violation doctrine. Discrete acts (termination, denial of promotion, demotion, pay reduction) each trigger their own 180/300-day clock.   • Confidentiality. ASCHR investigations are generally confidential during the investigative phase per 6 AAC 30. Public hearings and final orders are public records.
  • Retaliation. AS 18.80.220(a)(4) and 42 U.S.C. § 2000e-3(a) protect complainants from retaliation for filing this Charge or assisting in any proceeding. Document and report retaliation to ASCHR immediately.
  • Local agencies. Anchorage Equal Rights Commission (AERC) processes municipal-ordinance complaints under AMC Chapter 5.20 within Anchorage. Juneau, Sitka, and Ketchikan have separate municipal procedures. Complainants in those jurisdictions may file with both ASCHR and the local agency.
  • Federal-only bases. Sexual orientation and gender identity (employment), genetic information (GINA), and veteran status (USERRA) are not enumerated in AS 18.80 employment provisions and should be filed with EEOC (and AERC where applicable) for full protection. Real-property discrimination based on SO/GI is covered under AS 18.80.240.
