II. DEFINITIONS

For purposes of this Affidavit, the following terms have the meanings set forth below. Capitalized terms not defined herein have the meanings ascribed to them in the California Code of Civil Procedure and applicable court rules.

“Acknowledgment of Receipt” means Judicial Council form POS-015 or a substantially similar written acknowledgment executed pursuant to California law.

“Document(s) Served” means collectively the pleading(s) and/or paper(s) identified in Section III.A.

“Party Served” means the individual, entity, or authorized agent upon whom service of the Document(s) Served was effected.

“Service Date” means the calendar date on which the Document(s) Served were personally delivered or otherwise deemed served in accordance with California procedural law.

“Substituted Recipient” means a person other than the Party Served who was authorized by statute to accept service on behalf of the Party Served.

IV. REPRESENTATIONS & WARRANTIES OF AFFIANT

  1. Capacity. Affiant is at least 18 years of age and not a party to the above-captioned action.
  2. Truthfulness. All statements contained herein are true and correct of Affiant’s personal knowledge, and if called to testify Affiant could and would competently do so.
  3. Qualification. If service was performed as a registered process server, Affiant’s registration was active and in good standing at the time of service.
  4. Compliance. Affiant complied with all applicable provisions of the California Code of Civil Procedure, the California Rules of Court, and any local court rules governing service of process.
  5. No Additional Warranties. Except as expressly set forth herein, Affiant makes no further representations or warranties, express or implied.

V. GENERAL PROVISIONS

  1. Governing Law. This Affidavit shall be construed in accordance with, and all disputes arising hereunder shall be governed by, the procedural law of the State of California.
  2. Forum Selection. Any challenge to the sufficiency, validity, or timeliness of service described herein shall be brought exclusively in the California state court identified in the caption above.
  3. Severability. If any portion of this Affidavit is held unenforceable, the remaining provisions shall remain in full force to the maximum extent permitted by law.
  4. Counterparts & Electronic Signatures. This Affidavit may be executed in counterparts, each of which is deemed an original, and electronic signatures shall be deemed to have the same force and effect as original signatures to the fullest extent permitted by California law, including the Uniform Electronic Transactions Act, Cal. Civ. Code § 1633.1 et seq.
