I. DOCUMENT HEADER

II. DEFINITIONS

Unless otherwise indicated, capitalized terms have the meanings set forth below:

“Business Day” means any day other than a Saturday, Sunday, or legal holiday in the State of Arizona.
“Service Address” means the location at which service was effected, as specified in Section III.
“Service Date” means the calendar date on which service was effected, as specified in Section III.
“Substitute Service” means service accomplished by leaving the Documents at the Recipient’s usual place of abode with a person of suitable age and discretion pursuant to Ariz. R. Civ. P. 4.1(d).

V. COVENANTS

1. Preservation of Records. Affiant shall retain originals or true copies of all notes, proofs of delivery, signed receipts, and other evidence of service (the “Service Records”) for a period of at least two (2) years from the Effective Date and shall produce such records upon reasonable request or court order.
2. Continuing Duty. Affiant covenants to cooperate with any lawful inquiry, deposition, or testimony regarding the service described herein.

VI. DEFAULT & REMEDIES

1. False Statement. Any material misrepresentation by Affiant constitutes perjury under A.R.S. § 13-2702 and may subject Affiant to criminal penalties, civil sanctions, and contempt of court.
2. Failure to Retain Service Records. If Affiant fails to maintain Service Records as required, the court may disregard this Affidavit and impose sanctions it deems just and proper.

VII. GENERAL PROVISIONS

1. Severability. If any provision of this Affidavit is held invalid or unenforceable, all other provisions shall remain in full force and effect.
2. Integration. This Affidavit constitutes the entire statement of service and supersedes any prior oral or written statements by Affiant regarding the subject matter herein.
3. Governing Law. This Affidavit shall be governed by, and construed in accordance with, the laws of the State of Arizona without regard to conflict-of-law principles.
