2. Notice of Protected Termination

10. New York Route — Real Property Law § 227-c
This route is limited to a tenant or household member who is a victim of domestic violence as defined by Social Services Law § 459-a and reasonably fears remaining because of potential further domestic violence.
Deliver written notice to the landlord/owner or agent and to any cotenants other than the perpetrator. The termination date must be at least 30 days after delivery. First-class-mail notice is deemed delivered five days after mailing. The notice must state the victim status and the reasonable belief that the tenant or household member cannot safely remain.
Within 25 days after the notice, provide one or more permitted documents: a temporary or final protection order; a federal, state, or local law-enforcement record/report; a health-care-provider treatment record; or written verification from a qualified third party.
Rent is adjusted through the termination date; later prepaid rent is refundable. The statute restricts disclosure of the termination, victim status, and supporting documents, and prohibits describing the event to prospective landlords as an early termination. Non-perpetrator cotenants must receive the statutory notice; do not assume this form alone ends their rights or duties.
