TWO TYPES OF PROTESTS

Type 1: Pre-Bid Specification Challenge (N.J.A.C. 17:12-3.2)

What may be challenged: The terms, conditions, or specifications of a solicitation document (RFP or bid specification).

Deadline: Must be filed no later than the deadline for submission of bids or proposals as stated in the solicitation.

Standing: Any prospective bidder or offeror who intends to submit a bid or proposal.

Type 2: Post-Award Challenge (N.J.A.C. 17:12-3.3)

What may be challenged:

STAY OF AWARD / SUSPENSION PROVISIONS

Automatic 10-Business-Day Hold

Under N.J.A.C. 17:12-3.3, the Division holds contract awards for ten (10) business days after issuing the notice of intent to award to allow protests to be filed. During this period, the contract is not executed.

Director's Discretion to Proceed

The Director may award and execute a contract before the protest period expires or before a pending protest is resolved if:

Public exigency requires immediate contract execution.

Seeking Additional Stay

If the automatic hold period has expired or the Director exercises discretion to proceed:

REVIEW AND DECISION PROCESS

APPEAL PROCESS
