Filing Tips

AGENCY RESPONSE REQUIREMENTS
Statutory Timeline
Under N.J.S.A. 52:14B-4(f) and N.J.A.C. 1:30-4.1 through 4.2:
| Action | Deadline | Authority |
|---|---|---|
| Agency date-stamps and logs petition | Upon receipt | N.J.A.C. 1:30-4.1 |
| Agency files notice with OAL | Within 15 days of receipt | N.J.A.C. 1:30-4.1(c) |
| Notice published in NJ Register | Next available edition | N.J.A.C. 1:30-4.1(c) |
| Agency mails written response to petitioner | Within 60 days of receipt | N.J.S.A. 52:14B-4(f) |
| Agency files notice of action with OAL | Within 60 days of receipt | N.J.S.A. 52:14B-4(f) |
Possible Agency Responses
The agency may take one of the following actions on the petition:
☐ Grant the petition -- initiate rulemaking proceedings consistent with the petition
☐ Grant in part -- initiate rulemaking on some but not all requested provisions
☐ Deny the petition -- decline to initiate rulemaking, with written reasons
☐ Defer action -- postpone decision pending further study (must still respond within 60 days)
☐ Refer to another agency -- if the subject matter falls within another agency's jurisdiction
Failure to Act
If the agency fails to act within the 60-day timeframe:
- The petitioner may submit a written request to the Director of the Office of Administrative Law
- Upon written request, the Director shall order a public hearing on the rulemaking petition
- This enforcement mechanism ensures that agencies cannot simply ignore properly filed petitions
Important: This is a significant enforcement right under New Jersey law. The OAL Director's authority to order a public hearing gives New Jersey petitioners stronger recourse than in many other states.
APPEAL OF DENIAL
Administrative Remedies
If the agency denies the petition:
-
Request Reconsideration: File a written request for reconsideration with the agency, identifying new evidence or arguments not previously considered.
-
OAL Hearing Request: If the agency fails to respond within 60 days, request a public hearing through the Director of the Office of Administrative Law under N.J.S.A. 52:14B-4(f).
-
Governor's Office: Consider petitioning the Governor's Office, which maintains oversight authority over executive branch agencies.
-
Legislative Channels: Contact the relevant legislative committees that oversee the agency to request legislative pressure or intervention.
Judicial Review
If administrative remedies are exhausted:
-
Appellate Division Review: File an action in the Superior Court of New Jersey, Appellate Division, challenging the agency's denial of the petition.
-
Standard of Review: Courts review agency rulemaking decisions under an arbitrary, capricious, or unreasonable standard. The agency's refusal to initiate rulemaking is generally given deference, but must be supported by reasoned decision-making.
-
Standing: The petitioner must demonstrate standing -- a sufficient stake in the outcome, meaning a personal and direct injury or harm.
-
Timing: Judicial review should be sought within 45 days of the final agency action under New Jersey Court Rules R. 2:4-1.

PRACTICE TIPS FOR NEW JERSEY PRACTITIONERS
Before Filing
-
Research the agency's existing rules -- review the relevant portions of the New Jersey Administrative Code (N.J.A.C.) to understand the current regulatory framework and identify specific gaps or problems.
-
Check agency-specific petition procedures -- some agencies have adopted their own regulations governing petitions for rulemaking (e.g., DEP at N.J.A.C. 7:1D-1.1). Always check the agency's own rules before filing.
-
Review the NJ Register -- check the New Jersey Register for any pending rulemaking on the same or similar topic. A pending proposal may make your petition moot or may present an opportunity to submit comments instead.
-
Build stakeholder support -- gather letters of support from affected parties, industry groups, advocacy organizations, or other stakeholders. A petition with broad support is more likely to be taken seriously.
-
Engage the agency informally first -- consider meeting with agency staff before filing to discuss the regulatory concern. Agencies may be more receptive to a petition that reflects prior dialogue.
Drafting the Petition
-
Be specific in proposed language -- draft actual regulatory text rather than general descriptions. Agencies are more likely to act on petitions that provide ready-to-adopt language.
-
Cite specific statutory authority -- identify the precise statutory provisions that authorize the agency to adopt the proposed rule. Do not rely solely on the APA petition provision.
-
Address the Regulatory Flexibility Act -- if the proposed rule would impact small businesses, include analysis under N.J.S.A. 52:14B-16 et seq.
-
Anticipate objections -- address likely counterarguments in the petition to demonstrate thorough analysis.
-
Include cost-benefit analysis -- quantify the economic impact of the proposed rule wherever possible, including both costs to regulated entities and benefits to the public.
After Filing
-
Track the 15-day OAL notice deadline -- monitor whether the agency files the petition notice with the Office of Administrative Law within 15 days of receipt.
-
Track the 60-day response deadline -- calendar the 60-day deadline for the agency's written response and OAL filing.
-
Exercise the OAL hearing right -- if the agency fails to respond within 60 days, promptly submit a written request to the Director of the OAL for a public hearing. This is a powerful enforcement mechanism unique to New Jersey.
-
Monitor the NJ Register -- watch for publication of the agency's notice regarding the petition and any subsequent rulemaking activity.
-
Preserve all records -- keep copies of all filings, correspondence, and date-stamped receipts for potential judicial review.

About This Template
Administrative law covers how you interact with government agencies, from filing a comment on a proposed rule to appealing a denied license or benefit. Agency processes have their own forms, deadlines, and evidence standards that are different from what courts use. Getting the paperwork wrong usually means missing a deadline or losing the right to appeal, so precision in these documents matters as much as it does in a courtroom filing.
Important Notice
This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
