IMPORTANT: Tennessee vehicle registration and titling is administered at the County Clerk's office in each of Tennessee's 95 counties. Requirements and local fees may vary by county. Watercraft registration is administered by the Tennessee Wildlife Resources Agency (TWRA) through the County Clerk's office. Tennessee is a non-title state for boats -- there is no boat titling system.

SALES TAX: Tennessee imposes a 7% state sales tax plus local sales tax (up to 2.75% additional) on motor vehicle purchases, for a combined rate of up to 9.75% (some counties may reach 10%). Local sales tax on vehicles is typically capped at the first $1,600 of the purchase price.

NO SAFETY OR EMISSIONS INSPECTION: Tennessee ended its safety and emissions testing program in February 2022. No periodic safety or emissions inspection is currently required for any passenger vehicles.

Tennessee Practice Note: Under T.C.A. § 47-2-316, to effectively disclaim the implied warranty of merchantability, the disclaimer must mention "merchantability" and, if in writing, must be conspicuous. To disclaim the implied warranty of fitness, the disclaimer must be in writing and conspicuous. IMPORTANT: Tennessee ENDED its vehicle safety and emissions inspection program in February 2022. NO periodic safety inspection or emissions test is currently required for any passenger vehicles in Tennessee. Previously, emissions testing was required only in certain counties (Davidson, Hamilton, Rutherford, Sumner, Williamson, and Wilson). This program has been completely discontinued.

SECTION 9: TENNESSEE WATERCRAFT REQUIREMENTS

IMPORTANT TENNESSEE REQUIREMENTS:

Per T.C.A. § 69-10-201 et seq. and TWRA regulations:

  1. No Titling: Tennessee is a non-title state for boats. There is no boat titling system. A bill of sale is the primary proof of ownership.

  2. Registration Required: All mechanically powered vessels (including those with electric trolling motors) and all sailboats principally used in Tennessee must be registered. Boats powered only by oars or paddles are exempt from registration.

  3. Registration Process: Registration is handled through the County Clerk's office. A certified Application for Boat Certificate of Number is required. The applicant receives a yellow temporary registration valid for 60 days to allow for processing.

  4. Registration Duration: A Certificate of Number (registration) is valid for 1, 2, or 3 years, at the option of the owner.

  5. Registration Numbers: Tennessee registration numbers (TN prefix) must be displayed on both sides of the bow in block letters at least 3 inches high, in a color contrasting with the hull.

  6. Boating Safety Education: All Tennessee residents born after January 1, 1989 must complete a TWRA-approved Boating Safety Course and carry the TWRA-issued Boating Education Certificate when operating a boat. For out-of-state boaters born after January 1, 1989, any NASBLA-approved boating safety certificate is acceptable.

  7. Life Jackets: A U.S. Coast Guard-approved wearable PFD must be aboard for each person. Children under 13 must wear a PFD while the vessel is underway.

  8. Proof of Ownership: Because Tennessee does not title boats, the bill of sale, previous registration, manufacturer's statement of origin, or other documentation serves as proof of ownership. Retain this Bill of Sale as a permanent ownership record.

TENNESSEE INSPECTION REQUIREMENTS

Safety Inspection: Tennessee does NOT require periodic safety inspections for passenger vehicles. There is no state-mandated vehicle safety inspection program.

Emissions Testing: Tennessee ended its emissions testing program in February 2022. Previously, emissions testing was required in the following counties: Davidson, Hamilton, Rutherford, Sumner, Williamson, and Wilson. This program has been completely discontinued and no emissions testing is required anywhere in Tennessee.

IMPORTANT: While Tennessee does not require inspections, this does not mean a vehicle is guaranteed to be in safe operating condition. Buyers are strongly encouraged to have any used vehicle inspected by a qualified independent mechanic before purchase.
