KENTUCKY COMPREHENSIVE BILL OF SALE PACK

This comprehensive Bill of Sale Pack provides templates for transferring ownership of various types of property under Kentucky law. Select the appropriate form based on the property being transferred.

IMPORTANT: Kentucky vehicle and vessel titling is administered through the county clerk offices. Form TC 96-182 (Application for Kentucky Certificate of Title/Registration) is required for vehicle title transfers, and Form TC 96-184 (Motor Boat Transaction Record/Application for Registration and/or Title) is required for boat title transfers. All applications must be filed within 15 days of purchase.

INSPECTION NOTE: Kentucky requires an annual safety inspection covering lights, wipers, horn, brakes, tires, and exhaust. Kentucky does NOT require emissions testing (the emissions program ended in 2005).

KENTUCKY SAFETY INSPECTION REQUIREMENTS

Annual Safety Inspection:

Kentucky requires an annual safety inspection for all vehicles operated on public roads. The inspection covers:

  • Headlights — high and low beam operation
  • Tail lights — operation and visibility
  • Brake lights — operation
  • Turn signals — front and rear operation
  • Windshield and windows — glass condition, no cracks obstructing view
  • Windshield wipers — operation and condition
  • Horn — operation
  • Brakes — service brakes and parking brake operation
  • Tires — tread depth (minimum 2/32"), condition, no exposed cords
  • Exhaust system — no leaks, proper muffler function
  • Mirrors — rear-view mirror required
  • Seat belts — operation (where equipped)

Inspections are performed at authorized inspection stations and by county sheriffs' offices throughout the Commonwealth. Contact your local county sheriff's office for vehicle inspection services.

Emissions Inspection:

Kentucky does NOT require emissions testing. The state's emissions inspection program ended in 2005 and has not been reinstated. There is no county-level emissions requirement anywhere in Kentucky.

TITLE SIGNATURE AND NOTARIZATION REQUIREMENTS

Critical Requirement: When transferring a Kentucky title:

  1. The Seller must sign the back of the title exactly as the name appears on the front of the title.
  2. The Seller's signature on the back of the title must be notarized — this is separate from the bill of sale notarization requirement.
  3. Both the Seller and Buyer sections of the title assignment (or Form TC 96-182 for older titles) must be completed.
  4. The county clerk will NOT process a title transfer without a notarized seller signature on the title.

TIMELINE REQUIREMENTS

KENTUCKY MINIMUM LIABILITY INSURANCE REQUIREMENTS

Kentucky minimum liability insurance requirements (KRS § 304.39-110):

  • $25,000 per person for bodily injury
  • $50,000 per accident for bodily injury
  • $25,000 per accident for property damage
  • $10,000 Basic Reparation Benefits (BRB/PIP — Personal Injury Protection)

Kentucky is a no-fault insurance state. Proof of insurance is required before operating a motor vehicle on Kentucky public roads. When presenting insurance to the county clerk for registration, the insurance card cannot have an effective/issue date older than 45 days from the date presented.

MOTOR VEHICLE USAGE TAX — 6%

IMPORTANT: Kentucky's 6% motor vehicle usage tax (KRS Chapter 138) applies to ALL vehicle transfers — both dealer and private-party sales. Key points:

  1. The tax is collected by the county clerk at the time of title application.
  2. Tax is calculated on the greater of the purchase price or the fair market value (as determined by reference guides used by the county clerk).
  3. Trade-in credit: If you trade in a vehicle as part of the purchase, the trade-in value may be deducted from the purchase price before calculating tax.
  4. Gift transfers: A bona fide gift between immediate family members may qualify for reduced or waived usage tax with a properly executed gift affidavit.
  5. Out-of-state purchases: If you paid sales tax in another state, you may receive a credit against Kentucky's usage tax (up to the amount of Kentucky's tax).

This Kentucky Bill of Sale Pack is provided for informational purposes. Users should verify current requirements with their county clerk's office and the Kentucky Transportation Cabinet, and consult with a licensed Kentucky attorney for legal advice.

About This Template

A contract is a written record of what two or more parties agreed to and what happens if someone does not follow through. Clear language, defined terms, and clean signature blocks keep disputes small and enforceable. The most common mistakes in contracts come from vague promises, missing details about timing or payment, and skipping standard protective clauses like governing law and dispute resolution.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
