Oklahoma: Pay Stub Requirements

verified against the statute 2026-07-14 7 statute sources

The short answer

Yes. With each wage payment, an Oklahoma employer must give the employee a brief itemized statement of all deductions; the law does not prescribe gross pay, hours, rates, net pay, pay-period dates, or party-identification fields. The Oklahoma Department of Labor says the stub may be paper or electronic, and the employer has up to three days after payday to comply.

Requirements one by one

Statement duty and timing

40 O.S. § 165.2 says, "With each payment of wages earned by such employee, the
employer shall issue to such employee a brief itemized statement of any and all
deductions therefrom." The same section allows the employer three days after
payday to comply. The Oklahoma Department of Labor likewise answers yes when
asked whether a stub is required with each wage payment.

Required fields

Oklahoma's statutory field list is limited to deductions. Section 165.2 calls
for a "brief itemized statement of any and all deductions" but does not add
gross wages, net wages, hours, rates, pay-period dates, payment date, or
employer and employee identifiers.

Paper or electronic delivery

The Department of Labor says pay stubs "may be in either a paper or electronic
format." The cited statute and agency guidance do not state an employee-consent
requirement, paper opt-out, or a condition that the employee be able to print
or store an electronic statement.

Access and records

The Department's wage-claim page says an employee has a right to access wage
records and may submit a Pay Stub Claim Form if the employer refuses to provide
pay stubs or online access. Section 165.2 does not state how long an employer
must retain stubs, set a historical-copy response deadline, or authorize a copy
fee.

Enforcement

Under 40 O.S. § 165.7(A), the Commissioner of Labor enforces the wage-payment
act. Subsection (G) also lets a person aggrieved by a violation of §§ 165.1
through 165.11 bring an action to enforce those provisions.

A repeated-violation threshold applies to the administrative fine. Section
165.2a authorizes a $500 fine when violations occur on two or more occasions
within six months. Section 165.8 separately makes an employer's violation of
the covered wage-payment provisions a misdemeanor.

Section 165.9's lawsuit and fee language is written for an action to recover
unpaid wages and liquidated damages. A missing or incomplete statement does not
itself establish unpaid wages, so that section's damages and attorney-fee route
should not be presented as an automatic remedy for a stub-only violation.

What trips people up

The three-day provision is a compliance window after the scheduled payday. It
does not change the statement's content or convert Oklahoma's deduction-only
field list into a full accounting of earnings.

The statute mentions electronic means when discussing wage payment, but that
payment language is not the basis for electronic stubs. The Department of
Labor's own FAQ separately confirms that the pay stub itself may be paper or
electronic.

Common questions

Must an Oklahoma pay stub show hours, rates, gross pay, or net pay?

Not under the cited general statement rule. Section 165.2 requires a brief
itemized statement of all deductions and does not list those additional fields.

What if the employer does not provide a stub or online access?

The Oklahoma Department of Labor's wage-claim page directs employees to its Pay
Stub Claim Form when an employer refuses to provide pay stubs or online access.

Does every missing stub automatically produce a $500 fine?

No. Section 165.2a's $500 administrative fine requires violations on at least
two occasions within a six-month period. Other enforcement provisions may
still apply to a violation before that repeat threshold is met.
