Appealability of civil contempt orders

Section 512.020 does not make an order granting a permanent injunction appealable when the trial court never dissolved an injunction.

BURKY v. Stephan · filed 2005-10-11

Appellant has filed a response to the motion to dismiss. He first contends the order granting injunctive relief is appeal-able under section 512.020, RSMo Cum. Supp.2004, because it is the same as “dissolving an injunction.” We disagree. The trial court never dissolved an injunction. Before signing the order granting the permanent injunction, the trial court made some notations in handwriting that changed the form order from a temporary injunction to a permanent injunction. Despite Appellant’s assertions, this is not the same as dissolving an injunction that has already been entered.

Denial of summary judgment

Section 512.020 generally does not permit an appeal from denial of a summary judgment motion because the denial is not a final judgment.

Krenski v. Aubuchon · filed 1993-12-14

Denial of a motion for summary judgment is generally not a final judgment and therefore not appealable.

Section 512.020 does not permit appellate review of a denial of summary judgment, even after a final judgment.

State Ex Rel. Missouri Division of Transportation v. Sure-Way Transportation, Inc. · filed 1994-08-30

Denial of a motion for summary judgment is not subject to appellate review, even when an appeal is taken from a final judgment and not from the denial of a motion for summary judgment.
