Successful party and costs

Petersen v. Fontes · filed 2025-11-24

The Secretary requests attorney fees and costs under A.R.S. §§ 12-341 and -348.01. Because neither the Legislators nor the Secretary prevailed, the court exercises its discretion and denies those requests.

For competing monetary claims arising from the same facts, section 12-341 generally treats the net judgment winner as the successful party for costs.

Gipson v. Shinnink · filed 2025-12-08

These cases indicate that when, as here, parties have conflicting claims and counterclaims for money damages arising out of the same facts (here the contract between Gipson and Rental Renovators), the “net judgment rule” is the presumptive standard applicable to determine the successful party. ... For these reasons, the superior court erred in finding Rental Renovators was the “successful party” under A.R.S. §§ 12-341 and -341.01(A) as to Gipson.

JARVIS v. ABLOY · filed 2026-02-27

Defendants request an award of their reasonable attorneys’ fees, citing ARCAP 21, and their costs, citing A.R.S. § 12-341. ... We thus deny Defendants’ request for fees, but grant them their costs subject to their compliance with ARCAP 21.

A factual error about whether a party requested attorneys’ fees does not, by itself, make that party a successful party entitled to costs under § 12-341.

Hancock v. Martinez · filed 2026-03-17

This Court also declines to award Father his costs on appeal. Though the superior court erred in stating he did not ask for attorneys’ fees, such an error of fact does not deem Father a “successful party” under A.R.S. § 12-341.

Stone v. Pima County · filed 2026-06-11

Costs in probate

Section 12-341 leaves the probate court discretion to tax costs in a will contest before probate.

Panagiotis v. Miltiades · filed 1972-05-16

It is also pertinent to note that the case cited herein for the proposition that a probate court has discretionary authority in decisions which relate to the taxing of costs was based upon a judicial interpretation of A.R.S. § 12-341 which has remained unchanged and not upon Rule 54(f) in its original form. ... We further hold that while the statutes do not mandate the taxation of costs in this instance the trial court is free to exercise its discretion with regard thereto.

Scope and allocation of costs

Section 12-341 entitles the successful party in a civil action to recover costs; defendants jointly and severally liable on the judgment are each liable for the total allowed costs.

Welch v. McClure · filed 1979-07-02

A.R.S. § 12-341 provides that the successful party to a civil action is entitled to recover his costs from his adversary. ... The statute is silent on the method to be followed when there are more than one unsuccessful adversary. The general rule is that total costs are taxed against defendants who are jointly and severally liable on the judgment. ... We see no reason to depart from the general rule in this case. The costs should not have been apportioned, and each defendant should be liable jointly and severally for the total costs.

Section 12-341 does not allow a successful party to recover attorney’s fees as costs, even when another statute authorizes fees.

Boltz & Odegaard v. Hohn · filed 1985-08-20

It is well settled in Arizona that even where a statute provides for the award of attorney’s fees, the attorney’s fees are not “taxable costs” in the trial court under A.R.S. § 12-332, and may not be recovered by the “successful party” as “costs” under A.R.S. § 12-341.

Hales v. Humana of Arizona, Inc. · filed 1996-01-25

Section 12-341 requires an award of costs to the successful party in a civil action, but the specific discretionary costs provision for public-records actions controls when the two conflict.

Democratic Party of Pima County v. Beth Ford Pima County Board of Supervisors · filed 2012-01-27

In contrast, under § 12-341, an award of costs to the successful party is mandatory. Roddy v. Cnty. of Maricopa, 184 Ariz. 625, 627, 911 P.2d 631, 633 (App. 1996). Thus, the two statutes conflict, and the statute that is implicated specifically in this case—§ 39-121.02(B)—controls.
