THE ROOFING CONTRACTOR WILL HOLD IN TRUST EVERY PAYMENT FROM THE OWNER UNTIL THE CONTRACTOR HAS DELIVERED ROOFING MATERIALS TO THE PROPERTY OR PERFORMED A MAJORITY OF THE ROOFING WORK AT THE PROPERTY.

The contractor will describe unforeseen damage or requested changes in a written change order stating the added or reduced work, materials, price, and schedule effect. Both parties must sign it before that changed work begins, except for work needed immediately to protect the property, which requires the owner's separate written authorization.

3. Cancellation and deposit refund

The owner may cancel this agreement within 72 hours after signing and receive a full refund of any deposit. The contractor's cancellation and refund policy after that period is: [INSERT POLICY FOR ANY OTHER CANCELLATION, INCLUDING WORK ALREADY PERFORMED].

Additional insurance-denial rescission right: If the owner plans to pay for this work with property and casualty insurance proceeds, the owner may also rescind within 72 hours after receiving the insurer's written notice denying the roofing claim in whole or in part, subject to the statutory exception for unforeseeable supplemental roofing damage. The owner must give written rescission notice to the contractor at its physical address above within that period. The owner may transmit it electronically, mail it postage prepaid, or deliver it personally. A notice sent electronically is effective when transmitted; mailed notice is effective on deposit with the U.S. mail; personal delivery is effective when delivered.

After a qualifying insurance-denial rescission, the contractor will return payments, deposits and evidence of the owner's indebtedness within 10 days. The contractor may retain only payment for roofing work it actually performed in a workmanlike manner; the contractor's statutory right to seek the reasonable value of materials ordered and actually installed also remains subject to the governing statute.

4. Insurance deductible and claims

If insurance proceeds will pay for this work, the contractor will not pay, waive, rebate, or promise to pay, waive, or rebate any part of the owner's insurance deductible. 5. Performance and closeout

The contractor will perform the listed work in a workmanlike manner, protect the site reasonably, remove its debris, and provide the owner with [WARRANTY OR MANUFACTURER DOCUMENTS] at completion. The contractor will identify any subcontractors it plans to use: [NAMES OR METHOD OF NOTICE].

A contract is a written record of what two or more parties agreed to and what happens if someone does not follow through. Clear language, defined terms, and clean signature blocks keep disputes small and enforceable. The most common mistakes in contracts come from vague promises, missing details about timing or payment, and skipping standard protective clauses like governing law and dispute resolution.
