ARTICLE IV: LIMITED FIDUCIARY WARRANTY

Section 4.1 Special (Limited) Warranty in Representative Capacity

The Grantor warrants and will defend the title to the above-described premises only against the lawful claims and demands of all persons claiming by, through, or under the Grantor in the Grantor's fiduciary capacity, but against none other. This is a limited (special) warranty conveyance.

Section 4.2 No Personal Liability

This Deed is executed by the Grantor solely in the Grantor's representative capacity as Personal Representative of the Estate. The Grantor makes NO covenants or warranties, express or implied, in the Grantor's individual capacity, and shall have no personal liability hereunder. No general warranty of title is implied, and the Grantee takes title subject to all matters of record and of fact affecting the Decedent's title.


ARTICLE V: EXCEPTIONS AND RESERVATIONS

Important Legal Notes

  1. Court Confirmation: In a general (court-supervised) administration, the sale of estate real property must be reported to and confirmed by the District Court before conveyance (NRS 148.060; NRS 148.260–148.280). Attach a certified copy of the order confirming sale. In an independent administration with full authority, court confirmation is not required (NRS 143.375); with limited authority, confirmation/notice of proposed action applies (NRS 143.380).

  2. Conveyance After Confirmation: The Personal Representative executes the deed after confirmation of sale (NRS 148.280).

  3. Fiduciary Capacity: The Grantor signs and is acknowledged solely in the representative capacity; no individual warranties are made.

  4. Declaration of Value: Required for all deeds and must accompany this deed at recording; the recorder may refuse recording if transfer tax is unpaid (NRS 375.030).

  5. Title Insurance: Grantees should obtain title insurance given the limited fiduciary warranty.
