9. SOUTH DAKOTA-SPECIFIC REQUIREMENTS
9.1 At-Will Employment (S.D. Codified Laws § 60-4-4)
South Dakota law provides that an employment having no specified term may be terminated at the will of either party on notice to the other. This statutory provision reinforces the at-will nature of the employment relationship established by this offer letter.
9.2 Anti-Discrimination (S.D. Codified Laws § 20-13-10)
The Company does not discriminate on the basis of race, color, creed, religion, sex, ancestry, disability, or national origin, consistent with the South Dakota Human Relations Act.
9.3 Wage Payment Requirements (S.D. Codified Laws § 60-11-3)
- Wages must be paid on regular paydays designated by the employer
- Employers must pay at least once per calendar month
- Wages must be paid within 15 business days following the close of the pay period
9.4 Workers' Compensation (S.D. Codified Laws § 62-1-2)
South Dakota requires all employers to provide workers' compensation coverage. The Company shall maintain workers' compensation insurance in compliance with South Dakota law.
9.5 Final Paycheck (S.D. Codified Laws § 60-11-6)
Upon separation of employment, all wages earned but unpaid are due:
