IV. STATUTORY DISCLOSURES (C.R.S. § 15-5-813(2)(c))

Each qualified beneficiary is hereby notified of the following:

  1. Existence of the Trust. The trust identified in Section II exists and is now irrevocable (or, if the trigger is acceptance of trusteeship under § 15-5-813(2)(b), continues in administration under the trustee identified in Section I).

  2. Identity of the Settlor(s). The settlor(s) of the trust are identified in Section II.

  3. Right to Request Trust Portions. Each qualified beneficiary has the right, upon request to the Trustee, to be furnished promptly with a copy of the portions of the trust instrument that describe or affect the beneficiary's interest (C.R.S. § 15-5-813(2)(a)).

  4. Right to a Trustee's Report. Each qualified beneficiary has the right to a trustee's report at least annually and at the termination of the trust, containing the property, liabilities, receipts, and disbursements of the trust (including the source and amount of the trustee's compensation), a listing of trust assets, and (if feasible) their market values (C.R.S. § 15-5-813(3)).

  5. Right to Reasonable Information. The Trustee shall keep qualified beneficiaries reasonably informed about the administration of the trust and of the material facts necessary for them to protect their interests, and shall promptly respond to reasonable information requests (C.R.S. § 15-5-813(1)).

V. QUALIFIED BENEFICIARY DEFINITION (C.R.S. § 15-5-103(15))

A "Qualified Beneficiary" is a beneficiary who, on the date of qualification:

(a) Is a distributee or permissible distributee of trust income or principal;

(b) Would be a distributee or permissible distributee of trust income or principal if the interests of the distributees described in subparagraph (a) terminated on that date without causing the trust to terminate; OR

(c) Would be a distributee or permissible distributee of trust income or principal if the trust terminated on that date.

A charitable organization expressly designated to receive distributions, or a beneficiary who notifies the trustee under C.R.S. § 15-5-110, may also be treated as a qualified beneficiary.
