V. RIGHT TO REQUEST THE TRUST INSTRUMENT (§ 19-1308.13(b)(1) & (b)(3))

VI. RIGHT TO A TRUSTEE'S REPORT (§ 19-1308.13(c))

You have the right, as a qualified beneficiary, to receive a Trustee's Report. Pursuant to D.C. Code § 19-1308.13(c):

  • The Trustee shall annually, and at the termination of the Trust, send a report to the distributees and permissible distributees of trust income or principal;
  • Upon termination of the Trust, the Trustee shall send a report to other qualified beneficiaries who request it;
  • Upon a vacancy in the trusteeship (unless a cotrustee remains in office), the former trustee shall send a report to the qualified beneficiaries.

Pursuant to § 19-1308.13(c)(6), the term "report" means a report of the trust property, liabilities, receipts, disbursements, and distributions, including the source and amount of the Trustee's compensation, a listing of the trust assets, and, if feasible, their respective market values.

VII. RIGHT TO REASONABLE INFORMATION (§ 19-1308.13(a))

The Trustee shall keep the qualified beneficiaries of the Trust reasonably informed about the administration of the Trust and of the material facts necessary to protect their interests. Unless unreasonable under the circumstances, the Trustee shall promptly respond to a beneficiary's request for information related to the administration of the Trust (D.C. Code § 19-1308.13(a)).


VIII. QUALIFIED BENEFICIARY STATUS (D.C. Code § 19-1301.03(13))

Under D.C. Code § 19-1301.03(13), a "qualified beneficiary" means a beneficiary who, on the date the beneficiary's qualification is determined:

  • (A) Is a distributee or permissible distributee of trust income or principal;
  • (B) Would be a distributee or permissible distributee of trust income or principal if the interests of the distributees described in (A) terminated on that date without causing the Trust to terminate; or
  • (C) Would be a distributee or permissible distributee of trust income or principal if the Trust terminated on that date.
