III. CONSTITUTIONAL BASIS

The Sixth Amendment to the United States Constitution guarantees the Defendant the right to a trial "by an impartial jury of the State and district wherein the crime shall have been committed."

The Fourteenth Amendment to the United States Constitution guarantees the Defendant the right to due process of law, which includes the right to a fair trial before an impartial jury.

Article I, Section 8 of the Nevada Constitution provides that the accused shall have the right to "a speedy public trial by an impartial jury of the County or district in which the offense is alleged to have been committed."

The United States Supreme Court has recognized that when pretrial publicity or community prejudice is so pervasive as to render a fair trial impossible, a change of venue is constitutionally required. Sheppard v. Maxwell, 384 U.S. 333 (1966); Irvin v. Dowd, 366 U.S. 717 (1961).
IV. STATUTORY AUTHORITY
-
NRS 174.455 provides grounds for removal of a criminal action before trial when a fair and impartial trial cannot be had in the county where the case is pending due to prejudice.

NRS 174.465 authorizes the court to order removal of the action to another county upon a finding that the grounds for removal have been established.

NRS 174.475 governs the proceedings following an order for change of venue, including the transfer of papers and records to the receiving court.

NRS 174.485 provides that the expenses attendant to a change of venue shall be borne by the county from which the case is transferred.

Under Nevada law, the court generally must conduct voir dire examination before granting a change of venue, unless the pretrial publicity is so pervasive and inflammatory that prejudice is presumed. Nevius v. State, 101 Nev. 238 (1985).
V. FACTORS FOR COURT CONSIDERATION
- Nevada courts consider the following factors in evaluating a motion for change of venue:

NEVADA STATE PRACTICE NOTES
- Voir Dire Requirement: Nevada courts generally will not grant a change of venue until after voir dire examination demonstrates that an impartial jury cannot be empaneled. NRS 174.455. Be prepared to renew the motion during jury selection.
- Presumed Prejudice: In extreme cases of inflammatory and pervasive pretrial publicity, prejudice may be presumed without requiring voir dire. Nevius v. State, 101 Nev. 238 (1985).
- Appellate Review: The decision on a motion for change of venue is reviewable on appeal. NRS 174.455.
- Cost Allocation: Expenses of the change of venue are paid by the county from which the case is transferred. NRS 174.485.
- Electronic Filing: Most Nevada district courts use the Odyssey eFileNV system for electronic filing.
- Multiple Counties: Nevada has only 17 counties; in high-profile cases, consider that media coverage may extend statewide, particularly in cases originating in Clark County (Las Vegas) or Washoe County (Reno).
- Timing: File the motion as early as practicable and before trial commences.
