5. Statutory and Constitutional Authority
A. Minnesota Rule Authority
Minn. R. Crim. P. 24.03, subd. 1 permits a change of venue upon four grounds: (1) the court is satisfied that a fair and impartial trial cannot be had; (2) the convenience of parties and witnesses; (3) the interests of justice; and (4) as specified in Rule 25.02 regarding prejudicial publicity.
Minn. R. Crim. P. 25.02 specifically addresses cases involving prejudicial publicity and provides special procedures and timing for venue change motions based on such publicity.
Minn. R. Crim. P. 24.03, subd. 2 provides that transfer may be to any county within the geographical boundaries of the State of Minnesota (statewide).
