MAINE-SPECIFIC NOTES

  1. Equitable Distribution: Maine divides marital property in just proportions. There is no presumption of equal division (19-A M.R.S. § 953).

  2. Multiple Support Types: Maine provides five categories of spousal support under § 951-A: general, transitional (max 2 years), reimbursement, nominal, and interim.

  3. Preliminary Injunction: Upon filing, the court issues an automatic preliminary injunction prohibiting disposal of property and other actions (19-A M.R.S. § 903).

  4. 60-Day Waiting Period: A final hearing cannot occur until at least 60 days after the complaint is served.

  5. Residency Requirement: At least one party must have been a resident of Maine for at least six months before filing, or the parties must have been married in Maine and at least one resides there at filing (19-A M.R.S. § 901).

  6. Mediation: The court may require mediation for contested issues (19-A M.R.S. § 952-A).

  7. No-Fault Only: Maine has abolished fault-based grounds. The sole ground is irreconcilable marital differences (§ 902(1)(B)).

About This Template

Family law covers the paperwork that shapes divorce, custody, child support, adoption, guardianship, and other family matters. These filings are emotional and high-stakes, and they also have to meet strict procedural rules for service, financial disclosure, and parenting plans. Clean, accurate paperwork keeps the focus on getting a workable outcome for the family instead of getting derailed by technical problems that delay hearings or force amended filings.
