12. INTEGRATION AND SEVERABILITY

This Agreement constitutes the entire understanding between the Parties. It supersedes all prior negotiations, representations, and agreements. If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement shall be incorporated into and made part of the Final Decree of Divorce.

14. DELAWARE JURISDICTIONAL NOTES

  • Residency: At least one spouse must have been a Delaware resident (or military member stationed in Delaware) for 6 months before filing (13 Del. C. § 1504).
  • Waiting Period: No statutory waiting period after filing; however, the ground of incompatibility requires at least 6 months of living separate and apart.
  • Grounds: Irretrievable breakdown is the sole ground, demonstrated by: voluntary separation, separation caused by misconduct (adultery, abuse, desertion), mental illness requiring 2+ years of institutional care, or incompatibility with 6+ months separation (13 Del. C. § 1505).
  • Property Classification: Equitable distribution; marital property divided in proportions deemed just (13 Del. C. § 1513). All property acquired during marriage is presumed marital. Gifts from one spouse to the other remain marital property. Gifts/inheritance from third parties are separate.
  • Alimony: Available only to a "dependent party" who lacks property and earning ability. Duration capped at 50% of the marriage term; no cap for marriages of 20+ years (13 Del. C. § 1512). Terminates on remarriage, cohabitation, or death (§ 1519).
  • Filing: Family Court of the State of Delaware; file in the county where either party resides.
