IMPORTANT: THIS IS A PREPARATION GUIDE — NOT THE OFFICIAL COURT WORKSHEET

Maine requires the use of official form FM-040 (Child Support Worksheet) for child support calculations.
This template provides the substantive content and calculation methodology to help you
prepare — but you must transfer your figures to the official worksheet before filing.
The official form is available at https://www.courts.maine.gov/courts/family/divorce-separation/child-support.html.

10. MAINE-SPECIFIC NOTES

  • Income Shares Model: Maine uses the Income Shares Model, considering both parents' adjusted gross incomes to determine the total support obligation (19-A M.R.S. § 2006).
  • Means-Tested Benefits Excluded: Means-tested public assistance (TANF, SSI, SNAP, general assistance) is excluded from gross income (19-A M.R.S. § 2001(5)).
  • Enhanced Support Obligation: Maine provides for an enhanced support entitlement in certain circumstances, calculated separately from the basic support and not including child care, medical expenses, or health insurance (19-A M.R.S. § 2001(12-A)).
  • Shared Parenting Adjustment: When both parents have the child at least 30% of overnights, the calculation may be adjusted to reflect shared parenting costs.
  • Modification: Either party may seek modification upon a showing of substantial change in circumstances.
  • Interest: Overdue child support accrues interest at the rate established by the State Treasurer.

About This Template

Family law covers the paperwork that shapes divorce, custody, child support, adoption, guardianship, and other family matters. These filings are emotional and high-stakes, and they also have to meet strict procedural rules for service, financial disclosure, and parenting plans. Clean, accurate paperwork keeps the focus on getting a workable outcome for the family instead of getting derailed by technical problems that delay hearings or force amended filings.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
