3. STATEMENT OF DUTY AND FILING DEADLINES

Inventory (Wyo. Stat. § 2-7-403). Every personal representative shall make and return to the court, within one hundred twenty (120) days after appointment, a true inventory, upon oath, of all the estate of the decedent, including the homestead, if any, that has come to the personal representative's possession or knowledge. If the inventory is not filed within 120 days, the personal representative must show the court good cause for the delay and the court determines whether to allow an extension. Where Wyo. Stat. § 2-5-101 applies, the inventory shall be filed not more than seventy-five (75) days after the will has been admitted to probate.

Report of appraisal (Wyo. Stat. § 2-7-404). Within one hundred twenty (120) days after the timely filing of the inventory, the personal representative shall file, under oath, a report of appraisal of the values of the estate assets listed in the inventory, filed with the clerk of court.

4. APPRAISAL METHOD (Wyo. Stat. § 2-7-404)

Each asset is valued as of the date of the decedent's death. Under Wyo. Stat. § 2-7-404(a):

  • (i) For assets with a readily determinable market value, the value as of the date of death is stated in writing by one (1) disinterested person.
  • (ii) For assets without a readily determinable market value, the personal representative employs disinterested persons to determine the fair market value of each such asset as of the date of death; a separate written report for each such asset, showing the appraiser's basis, is attached.

Different persons may be employed to appraise different assets (§ 2-7-404(b)). Appraiser fees are within the personal representative's discretion, subject to the reasonableness and approval provisions of § 2-7-802(a) at the final report and accounting.
