4. STATEMENT OF DUTY AND FILING DEADLINE

Pursuant to Ala. Code § 43-2-835(a), within two (2) months after appointment, a personal representative (who is not a special administrator or a successor to a representative who has previously discharged this duty) shall file an inventory of property owned by the decedent at the time of death, listing it with reasonable detail and indicating, as to each listed item, its fair market value as of the date of the decedent's death and the type and amount of any encumbrance.

☐ This inventory is filed within two months after the personal representative's appointment.
☐ The court has, for good cause, extended the time for filing to [__/__/____].
☐ The will expressly exempts the personal representative from filing an inventory (Ala. Code § 43-2-311); this inventory is nonetheless prepared and furnished to interested persons.

Pursuant to Ala. Code § 43-2-835(b), the personal representative shall send a copy of this inventory to interested persons who request it.

5. APPRAISAL METHOD

Alabama law does not require a court-appointed appraiser for an ordinary estate inventory. The personal representative determines and states the fair market value of each item as of the date of death. Where the value of an asset is subject to reasonable doubt (e.g., real estate, closely held business interests, collectibles), the personal representative may engage a qualified, disinterested appraiser and attach the appraisal.

About This Template

Estate planning documents decide what happens to your property, your children, and your medical care when you cannot make those decisions yourself. Wills, trusts, powers of attorney, and health care directives each serve different purposes and each have to meet state law requirements for signing, witnessing, and notarization. A document that looks fine on the page but was not executed correctly can be rejected in probate, which is exactly when it is too late to fix.

Important Notice

This template is provided for informational purposes. It is not legal advice. We recommend having an attorney review any legal document before signing, especially for high-value or complex matters.
