Court Selection — Superior Court vs. Circuit Court: New Hampshire Superior Courts have original jurisdiction over civil actions. The Circuit Court — District Division handles small claims (RSA 503:1, up to $10,000), landlord/tenant proceedings, and certain other civil matters. Family Division and Probate Division matters require separate forms available from the NHJB.
Medical Malpractice Screening Panel: Per RSA 507-C:1 et seq., all medical injury claims must be submitted to a screening panel before trial. The panel hearing must occur within 11 months of filing. The panel's findings are admissible at trial but not conclusive.
Service of Process: Under RSA 510:2, civil process in New Hampshire is generally served by a sheriff or deputy sheriff. Service must be made at least 30 days before the return day of the writ (RSA 510:1). For corporate defendants, service may be made on the registered agent (RSA 293-A:5.04) or through the Secretary of State.
Statute of Limitations: New Hampshire limitation periods vary by cause of action. Common periods include: personal injury/property damage — 3 years (RSA 508:4); contract — 3 years (RSA 508:4); medical malpractice — 2 years from discovery (RSA 507-C:4); products liability — 3 years from injury (RSA 507-D:2).
Alternative Dispute Resolution: New Hampshire courts actively encourage ADR. Per RSA 490-E, a mediation and arbitration fund is maintained through a $10 surcharge on civil filing fees. Courts may order mandatory mediation in appropriate cases.
Damages Cap: New Hampshire does not impose a general cap on compensatory damages but does limit noneconomic damages in medical malpractice cases to $250,000 per RSA 507-C:7 (subject to exceptions).
