PRACTITIONER NOTES
Maryland-Specific Practice Considerations
-
Circuit Court vs. District Court: The District Court has exclusive jurisdiction for rent court, landlord-tenant cases, replevin actions, and civil claims up to $5,000. Circuit Court has exclusive jurisdiction over equity actions, title to real or personal property, and claims exceeding $30,000.
-
Baltimore City Considerations: Baltimore City is an independent jurisdiction with its own Circuit Court and DCM plan. Baltimore City has active specialty dockets and a detailed case management process.
-
MDEC Rollout: MDEC is fully deployed in all 24 Maryland Circuit Court jurisdictions. All attorneys are required to file electronically.
-
Service Deadline: Under Maryland Rule 2-507(b), if service is not made within 120 days after filing the complaint, the court may dismiss the action without prejudice.
-
Responsive Pleading: The defendant has 30 days after service to file an answer or responsive motion (Md. Rule 2-321(a)).
-
Health Claims Arbitration: Maryland requires health care malpractice claims to be submitted to the Health Claims Arbitration Office before filing in Circuit Court (Cts. & Jud. Proc. Article, Section 3-2A-01 et seq.).
-
Limitations Periods (Common):
- Contract: 3 years (Cts. & Jud. Proc. Section 5-101)
- Personal injury: 3 years (Cts. & Jud. Proc. Section 5-101)
- Property damage: 3 years (Cts. & Jud. Proc. Section 5-101)
- Medical malpractice: 5 years from injury or 3 years from discovery (Cts. & Jud. Proc. Section 5-109)
- Products liability: 3 years (Cts. & Jud. Proc. Section 5-101)
- Fraud: 3 years from discovery (Cts. & Jud. Proc. Section 5-203)
- Wrongful death: 3 years (Cts. & Jud. Proc. Section 3-904(g)) -
Contributory Negligence: Maryland is one of the few states that still follows pure contributory negligence -- any negligence by the plaintiff bars recovery entirely.
-
Local Rules: Each Circuit Court may have supplemental local rules, particularly for DCM, scheduling, and discovery. Montgomery County, Prince George's County, and Baltimore City have especially detailed local rules.
-
Business and Technology Case Management Program: Several Circuit Courts maintain specialized programs for complex business and technology cases. Check local rules for eligibility.
