Filing the AOC-104

  1. Official Form Required. This worksheet does not replace the official AOC-104 form. The official form must be filed with the initial pleading (complaint, petition, or other initiating document). eFiling users will enter cover sheet information directly into the eFiling portal. Paper filers must complete and attach the printed AOC-104.

  2. One Case Type Only. The AOC-104 requires selection of a single primary case type. If the case involves multiple claims, select the category you consider most important. This classification affects case assignment and statistical reporting.

  3. eFiling. Kentucky courts use the Kentucky eFiling system. Attorneys filing through the eFiling portal will be prompted to enter cover sheet information electronically. Visit https://ehelp.kycourts.net/rules-for-efiling/ for eFiling rules and instructions.

Jurisdictional Considerations

  1. District vs. Circuit Court. District Court handles civil cases of $5,000 or less and small claims of $2,500 or less (KRS 24A.120). Circuit Court has general jurisdiction over all other civil matters (KRS 23A.010). Verify jurisdictional amount before filing.

  2. Venue. Under KRS 452.400 et seq., venue generally lies in the county where the defendant resides, where the cause of action arose, or where the property in dispute is located. Improper venue may be grounds for transfer or dismissal.

Special Case Types

  1. Domestic Relations. Dissolution of marriage, custody, child support, and other family law matters have their own procedural requirements under KRS Chapter 403. Certain counties may have Family Court divisions with specialized procedures.

  2. Probate/Estate. Probate matters are governed by KRS Chapters 394-395. These cases may be assigned to a specific probate division in larger counties.

  3. Administrative Appeals. Appeals from administrative agencies are filed in Circuit Court under KRS 13B.140. The appeal must be filed within 30 days of the final agency order.
