ARIZONA PRACTICE NOTES
-
Bankruptcy district. Arizona is a single federal judicial district: the U.S. Bankruptcy Court for the District of Arizona, with divisional offices in Phoenix, Tucson, Yuma, and Flagstaff. File in the District of Arizona where the debtor has been domiciled, resided, or had a principal place of business or principal assets for the greater part of the 180 days before filing (28 U.S.C. § 1408). Confirm divisional assignment and the District of Arizona Local Rules.
-
Community property (Arizona). Arizona is a community-property state. In a joint case, and even in an individual case for a married debtor, community income and the non-filing spouse's income are relevant to current monthly income. Carefully document the marital adjustment on Form 122A-2 for income of a non-filing spouse not used for the household.
-
Median family income. Arizona median family income figures are set by Census Bureau data published by the U.S. Trustee Program and are updated roughly every six months. The figures in Part 3 reflect the April 1, 2026 table; verify the figure for your household size and filing date at https://www.justice.gov/ust/means-testing.
-
IRS expense standards. National Standards, Local Standards (housing/utilities and transportation), and Other Necessary Expenses are published by the UST for each filing period. Arizona housing/utilities allowances are county-specific (e.g., Maricopa, Pima, Pinal); use the debtor's county. (Posting of updated IRS standards may be delayed pending the IRS Collection Financial Standards release — confirm the current set.)
-
§ 707(b)(2) thresholds. The $9,075 / $15,150 presumption thresholds are adjusted triennially (next adjustment due 2028). Verify the figures effective on the filing date.
