ARKANSAS PRACTICE NOTES
- Bankruptcy districts. Arkansas has two federal judicial districts: the United States Bankruptcy Court for the Eastern District of Arkansas (divisions include Little Rock, Helena/Eastern, Jonesboro/Northern, Pine Bluff, Batesville) and the Western District of Arkansas (Fayetteville, Fort Smith, El Dorado, Texarkana, Harrison, Hot Springs). The two districts share judges and the clerk's office administers both. File in the district covering the debtor's county of residence/domicile.
- Median income figures. Use the Arkansas median family income figure in effect on the petition date. The U.S. Trustee Program updates Census-based median income roughly every six months and applies a CPI adjustment early each year. Confirm at https://www.justice.gov/ust/means-testing.
- IRS Standards. National Standards (food/clothing/personal care) and Local Standards (housing & utilities by Arkansas county; transportation by region) are reproduced on the U.S. Trustee site and updated periodically. Use the version in effect for the petition date.
- Filing fee. The Chapter 7 filing fee is set under 28 U.S.C. § 1930; verify the current amount and any fee-waiver/installment options with the clerk.
- No state median override. The means test uses the federal/UST Arkansas median family income figures; there is no separate Arkansas statutory median. Exemptions (a separate analysis) are governed by Arkansas law and the federal alternative under 11 U.S.C. § 522.
