LAW AND ARGUMENT
FIRST ASSIGNMENT OF ERROR: [RESTATE ASSIGNMENT]
A. Standard of Review
☐ De novo review applies to questions of law. (State v. Burnside, 100 Ohio St.3d 152, 2003-Ohio-5372, ¶ 8.)
☐ Abuse of discretion applies to the trial court's evidentiary and discretionary rulings. The court must find the trial court's decision was unreasonable, arbitrary, or unconscionable. (State v. Adams, 62 Ohio St.2d 151, 157 (1980).)
☐ Sufficiency of the evidence: Whether, viewing the evidence in a light most favorable to the prosecution, any rational trier of fact could have found the essential elements of the crime proven beyond a reasonable doubt. (State v. Jenks, 61 Ohio St.3d 259 (1991); Jackson v. Virginia, 443 U.S. 307 (1979).)
☐ Manifest weight of the evidence: The court sits as a "thirteenth juror" and considers whether the jury clearly lost its way and created a manifest miscarriage of justice. (State v. Thompkins, 78 Ohio St.3d 380, 387 (1997).)
☐ Ineffective assistance of counsel: Defendant must demonstrate deficient performance and resulting prejudice. (Strickland v. Washington, 466 U.S. 668 (1984); State v. Bradley, 42 Ohio St.3d 136 (1989).)
B. Argument
[________________________________]
(T.p. [____].)
C. Prejudice / Harmless Error
☐ Constitutional error: The State must prove harmless error beyond a reasonable doubt. (Chapman v. California, 386 U.S. 18 (1967).)
☐ Non-constitutional error: Under Ohio Crim.R. 52(A), any error that does not affect substantial rights must be disregarded.
☐ Plain error: Under Ohio Crim.R. 52(B), plain errors affecting substantial rights may be noticed despite the lack of objection. Plain error exists where (1) there is an error, (2) the error is plain, and (3) the error affects substantial rights. (State v. Barnes, 94 Ohio St.3d 21, 27 (2002).)

STATE-SPECIFIC NOTES FOR OHIO
-
Notice of Appeal: Must be filed within 30 days of the entry of the judgment or order appealed. (Ohio R. App. P. 4(A).)
-
Page Limit: 35 pages for initial briefs, exclusive of tables of contents, tables of authorities, and appendices. (Ohio R. App. P. 16(C).) Check local rules for district-specific limits.
-
Filing Deadline: Appellant's brief is due 20 days after the clerk mails notice that the record is complete. (Ohio R. App. P. 18(A).)
-
Assignments of Error: Ohio uniquely uses "assignments of error" rather than "issues" or "points." Each must specifically identify the error and reference the record location.
-
Anders Brief: If appointed counsel finds no meritorious issues, counsel must file an Anders brief and request to withdraw. The court independently reviews the record. (Anders v. California, 386 U.S. 738 (1967); State v. Toney, 23 Ohio App.2d 203 (1970).)
-
Sufficiency vs. Weight: Ohio distinguishes between sufficiency of the evidence (legal standard, Jenks) and manifest weight of the evidence (factual review, Thompkins). Both should be raised if challenging the evidence.
-
Plain Error: Under Ohio Crim.R. 52(B), plain error may be raised on appeal even if not objected to below, but only to prevent a manifest miscarriage of justice. (State v. Long, 53 Ohio St.2d 91 (1978).)
-
Discretionary Appeal to Supreme Court: After the Court of Appeals decision, a memorandum in support of jurisdiction must be filed within 45 days with the Ohio Supreme Court. (S.Ct.Prac.R. 7.01(A)(1).)
-
Delayed Appeal: A defendant may file a motion for leave to file a delayed appeal under Ohio R. App. P. 5(A) if the notice of appeal was not timely filed.
