9. REPORTER CERTIFICATION, IMMUNITY, AND CONFIDENTIALITY

9.1. Certification. I hereby certify, under penalty of perjury under the laws of the State of Idaho and 18 U.S.C. § 1621, that the information set forth in this report is true and correct to the best of my knowledge, information, and belief, and that I have made this report in good faith pursuant to Idaho Code § 39-5303.

9.2. Statutory Immunity. Pursuant to Idaho Code § 39-5305, any person who participates in good faith in the making of a report under § 39-5303, in any judicial proceeding resulting from such report, or in the investigation thereof, is immune from civil or criminal liability that might otherwise be incurred by reason of such acts.

9.3. Confidentiality. Pursuant to Idaho Code § 39-5304, this report and the identity of the reporter are confidential and may be disclosed only as authorized by law (e.g., to APS, law enforcement, prosecuting attorneys, courts, and other agencies with statutory authority). Unauthorized disclosure may constitute a violation of state and federal privacy law.

9.4. Penalty for Failure to Report or False Report. Idaho Code § 39-5306 makes it a misdemeanor to (a) fail to report when required by § 39-5303 or (b) knowingly make a false report. Knowing exploitation, abuse, or neglect of a vulnerable adult is also separately punishable as a felony under Idaho Code § 18-1505.

10. IDAHO PRACTICE NOTES

  • 24-hour oral / 4-hour serious-injury rule. § 39-5303 requires mandatory reporters to call APS within 24 hours of forming reasonable cause. If the maltreatment caused or threatens death or serious physical injury, an additional report to law enforcement is required within 4 hours. The clock runs from when reasonable cause is formed, not when written documentation is completed.
  • Reasonable cause is a low threshold. A reporter need not be certain — only that the facts known would lead a reasonable person of ordinary prudence and caution to believe that a vulnerable adult is being or has been maltreated.
  • Permissive reporters protected too. Idaho Code § 39-5303(2) extends authority (not duty) to any person, including financial-institution employees, with reasonable cause. § 39-5305 immunity covers permissive reporters acting in good faith.
  • Vulnerable Adult Protection Orders. Idaho Code § 39-5310 et seq. authorize protection orders restraining contact, financial transactions, and presence in the vulnerable adult's residence — comparable to domestic-violence protection orders.
  • Self-neglect. Idaho APS routinely accepts self-neglect referrals. Capacity-based interventions may include guardianship/conservatorship under Idaho Code Title 15, Chapter 5.
  • Financial exploitation by fiduciary. Where the perpetrator holds a power of attorney, the reporter should also consider initiating a § 15-12-116 POA accounting demand and a § 39-5310 protection order freezing accounts.
  • Facility-based abuse. All reports involving long-term-care facilities should be cross-reported to the LTC Ombudsman (208-334-3833) AND DHW Bureau of Facility Standards (208-334-6626). Federal law (42 C.F.R. § 483.12) requires the facility itself to self-report covered incidents to the State Survey Agency within 24 hours (or 2 hours if serious bodily injury).
  • Tribal jurisdiction. Crimes against Indians on tribal land are subject to concurrent federal/tribal jurisdiction; coordinate with the relevant tribal law-enforcement agency and BIA.
  • Records retention. Reporters should retain copies of the written report, intake confirmation, and follow-up correspondence for a minimum of six years (longer for healthcare and licensed professionals subject to specific retention rules).
