Requirements one by one
First property record
Louisiana Code of Civil Procedure art. 4563(A) applies tutor inventory rules to curatorship. Under art. 4101(A), the court orders an inventory and appraisal or a detailed descriptive list on the application for appointment. Article 4563(B) permits a substitute list sworn and subscribed by the applicant with each item's fair market value unless the court orders otherwise.
Annual filings by role
Article 4569(A) separates the curator responsible for affairs, who files an annual account, from the curator responsible for the person, who files an annual report of the interdict's location and condition. Both duties recur at termination of the relevant office or responsibility and when the court orders. The article states an annual interval without a calendar filing day.
For the affairs account, art. 4569(A) applies art. 4393, which incorporates art. 3333. The account shows property at the beginning and end of the period, revenue and other receipts, disbursements, and property dispositions.
Copies and court oversight
At filing, art. 4569(A) requires first-class mailed copies of either required filing to the undercurator and any successor curator. Under art. 4569(B), the court may appoint an examiner to review an account or personal report and investigate further.
What trips people up
The same art. 4569(A) imports art. 4398's accounting-cost rule: an account not filed timely is at the curator's expense. The statute states no separate fixed annual calendar deadline, so the case's reporting date matters.
Common questions
Does the personal report need a financial ledger? Article 4569(A) describes the person report as a statement of location and condition; its affairs-account requirement is a separate filing tied to that responsibility.
What if one curator handles both person and affairs? Article 4569(A) assigns each report to the respective responsibility, so a curator holding both responsibilities has both filing duties.
May the court request a report between annual filings? Yes. Article 4569(A) permits court-ordered accounts or personal reports at other times.
